A bill to amend 1978 PA 368, entitled

"Public health code,"

(MCL 333.1101 to 333.25211) by adding section 12714a.

the people of the state of michigan enact:

Sec. 12714a. (1) An individual may install a shallow well casing on the individual's personal property without the approval of a local health official if the following requirements are met:

(a) The well casing does not extend more than 25 feet below the surface of the ground.

(b) The well will be used only for an agricultural purpose and not as a potable water source.

(2) As used in this section, "agricultural purpose" means irrigation for crops in commercial agriculture or for residential use.
