A bill to amend 1931 PA 328, entitled

"The Michigan penal code,"

(MCL 750.1 to 750.568) by adding section 335b.

the people of the state of michigan enact:

Sec. 335b. (1) An individual who knowingly engages in a course of conduct of sending unsolicited or nonconsensual sexually explicit videos or images to another individual is guilty of a misdemeanor punishable by imprisonment for not more than 90 days or a fine of not more than $2,000.00, or both.

(2) As used in this section:

(a) "Course of conduct" means a pattern of conduct composed of a series of 2 or more separate noncontinuous acts.

(b) "Nudity" means displaying an individual's genitalia or anus or, if the individual is a female, her nipples or areola.

(c) "Sexually explicit video or image" means a video or photograph that depicts nudity, erotic fondling, sexual intercourse, or sadomasochistic abuse.

Enacting section 1. This amendatory act takes effect 90 days after the date it is enacted into law.
