HOUSE BILL NO. 5083
A bill to amend 2000 PA 489, entitled
"Michigan trust fund act,"
by amending section 2 (MCL 12.252), as amended by 2020 PA 359, and by adding section 13.
the people of the state of michigan enact:
(a) "Community district education trust fund" means the community district education trust fund created in section 12.
(b) "Flint settlement trust fund" means the Flint settlement trust fund created in section 11.
(c) "Medicaid benefits trust fund" means the Michigan Medicaid benefits trust fund established in section 5.
(d) "Medicaid program" means a program for medical assistance established under title XIX of the social security act, 42 USC 1396 to 1396w-5.administered by this state under section 105 of the social welfare act, 1939 PA 280, MCL 400.105.
(e) "Medicaid special financing payments" means the Medicaid special adjustor payments each year authorized in the department of health and human services appropriations act.
(f) "Michigan merit award trust fund" means the Michigan merit award trust fund established in section 9.
(g) "Nonprofit sports commission" means a nonprofit corporation that meets both of the following requirements:
(i) Has received a state appropriation for the development or improvement of facilities for, or for large events promoting, sports-related tourism and recreation in northern Michigan.
(ii) Is organized for all of the following purposes:
(A) Fostering local, regional, national, and international sports competitions in northern Michigan.
(B) Promoting northern Michigan as a premier destination for athletic competition and recreational opportunities because of the region's strategic assets.
(C) Enhancing the economy and quality of life in northern Michigan.
(D) Providing to the general public and others information about the sports, tourism, and recreation industries near the Great Lakes in northern Michigan.
(E) Initiating, promoting, and sponsoring events related to the sports, tourism, and recreation industries near the Great Lakes in northern Michigan.
(h) (g) "Tobacco settlement revenue" means money received by this state that is attributable to the master settlement agreement incorporated into a consent decree and final judgment entered into on December 7, 1998 in Kelly Ex Rel. ex rel Michigan v Philip Morris Incorporated, et al., Inc., Ingham County Circuit Court , docket no. 96-84281CZ, (Docket No. 96-84281CZ), including any rights to receive money attributable to the master settlement agreement that has been sold by this state.
(i) (h) "21st century jobs trust fund" means the 21st century jobs trust fund established in section 7.
Sec. 13. (1) The northern Michigan tourism and sports fund is created as a trust fund within the state treasury.
(2) The state treasurer may receive money or other assets from any source for deposit into the fund. The state treasurer shall direct the investment of the fund. The state treasurer shall credit to the fund interest and earnings from fund investments.
(3) Money in the fund at the close of a fiscal year shall remain in the fund and shall not lapse to the general fund.
(4) The department of treasury is the administrator of the fund for auditing purposes.
(5) The department of treasury shall expend money from the fund, upon appropriation, only for grants to a nonprofit sports commission. The legislature finds that a grant under this section is for a public purpose.
(6) As used in this section, "fund" means the northern Michigan tourism and sports fund created in subsection (1).
