A resolution to urge the Congress of the United States and the United States Department of Defense to strengthen policies to prevent and respond to sexual assault and harassment in the military.
Whereas, A recent report on sexual assaults released by the U.S. Department of Defense found that the number of sexual assault reports by service members increased from Fiscal Year 2018 to Fiscal Year 2019, from 6,053 incidents to 6,236 incidents. Women between the ages of 17 and 24 reported the largest increase in sexual assault; and
Whereas, Toxic and harassing command cultures set the stage for sexual violence. Gender-based misperceptions and systemic gender discrimination affect workplace camaraderie, creating an environment where harassment can flourish. Ineffective responses to sexual harassment and assault have resulted in fear of retaliation and underreporting of cases by victims; and
Whereas, Environments that support harassment and sexual assault lead to additional violent crimes, including murder, as was the case with deaths at Fort Hood in 2020; and
Whereas, The new Secretary of Defense has expressed a serious commitment to eliminating this persistent problem in the military. Members of the United States Armed Forces make tremendous personal sacrifice on behalf of our nation and it is vital that our government does everything it can to protect them from harassment and assault; now, therefore, be it
Resolved by the House of Representatives, That we urge the Congress of the United States and the United States Department of Defense to strengthen policies to prevent and respond to sexual assault and harassment in the military; and be it further
Resolved, That copies of this resolution be transmitted to the United States Secretary of Defense, the President of the United States Senate, the Speaker of the United States House of Representatives, and the Michigan congressional delegation.

I unveiled the Michigan COVID Recovery Plan on January 19, 2021, emphasizing the urgency of getting federal funds out the door so we can protect Michiganders with the safe and effective vaccine, return to in‑person education safely, and provide relief to small businesses and families. This legislation arrived on my desk 48 days later – and not one of those days was spent negotiating with me and the State Budget Office to reach a bipartisan accord.
Normally, I provide state departments with guidance in implementing appropriations legislation by identifying budget boilerplate that violates the Michigan Constitution of 1963. In the interest of getting this money to work for Michigan, I am signing Enrolled House Bills 4047 and 4048 of 2021 without delay, absent the usual instructions to departments regarding implementation. However, when legal review of this bill’s budget boilerplate is complete, I will direct state departments to implement this legislation consistent with constitutional requirements.
In the attached copies that have been filed with the Secretary of State, I have disapproved 2 items in each bill, pursuant to article 5, section 19 of the Michigan Constitution of 1963.
Finally, I note that this legislation leaves more than $2 billion in federal money unappropriated. As Michigan goes all-out to finally beat back this awful pandemic and turn the page to recovery, we need every last dollar going to work for us before the Legislature takes its Spring Break. I look forward to teaming up to make that happen, and that’s why I’ve asked my budget director to convene a meeting to start negotiations as soon as possible. I know we share a basic desire to help Michiganders, and provide meaningful financial support to struggling businesses. Let’s get to work

I unveiled the Michigan COVID Recovery Plan on January 19, 2021, emphasizing the urgency of getting federal funds out the door so we can protect Michiganders with the safe and effective vaccine, return to in‑person education safely, and provide relief to small businesses and families. This legislation arrived on my desk 48 days later – and not one of those days was spent negotiating with me and the State Budget Office to reach a bipartisan accord.
Normally, I provide state departments with guidance in implementing appropriations legislation by identifying budget boilerplate that violates the Michigan Constitution of 1963. In the interest of getting this money to work for Michigan, I am signing Enrolled House Bills 4047 and 4048 of 2021 without delay, absent the usual instructions to departments regarding implementation. However, when legal review of this bill’s budget boilerplate is complete, I will direct state departments to implement this legislation consistent with constitutional requirements.
In the attached copies that have been filed with the Secretary of State, I have disapproved 2 items in each bill, pursuant to article 5, section 19 of the Michigan Constitution of 1963.
Finally, I note that this legislation leaves more than $2 billion in federal money unappropriated. As Michigan goes all-out to finally beat back this awful pandemic and turn the page to recovery, we need every last dollar going to work for us before the Legislature takes its Spring Break. I look forward to teaming up to make that happen, and that’s why I’ve asked my budget director to convene a meeting to start negotiations as soon as possible. I know we share a basic desire to help Michiganders, and provide meaningful financial support to struggling businesses. Let’s get to work

Today I am returning Enrolled House Bill 4049 to you without my approval.
Following the 1918 Spanish Flu Pandemic, the
Legislature granted the then-equivalent of the Director of the Department of
Health and Human Services broad power to issue orders to contain and eradicate
epidemics. This bill would prohibit the use of epidemic orders to close a
school to in-person instruction or prohibit a sporting event during the
COVID-19 epidemic. The bill would also severely limit the ability of local
health departments to do the same.
Both schools and sports are open in Michigan at this time. My administration has worked tirelessly to mobilize testing resources to enable a return to in-person school across this state. I set a goal that all schools return to in-person instruction by March 1, and 97% rose to the occasion. Sports, similarly, have resumed, subject to protections designed to keep both the participants and the community safe. Why the Legislature rushed this bill to my desk while they continue to let billions of dollars for schools and aid to Michigan families gather dust is a mystery to me.
I received a veto request letter for House Bill 4049 from the Michigan Association for Local Public Health (MALPH), noting MALPH’s firm opposition to this legislation. COVID-19 does not care about school district or local health department jurisdictional boundaries. As such, there may be times when a statewide order is necessary to protect Michiganders. Moreover, because school district boundaries in Michigan often cross county and health department boundaries, placing such authority exclusively at the local level makes little sense.
My number one priority has always been the safety and wellbeing of the people of Michigan. The pandemic has been hard on all of us. Our administration has stayed focused on doing the right things: acting decisively, following the science, and listening to the experts. Our actions have helped get the pandemic under control and rebuild the economy – but there’s still more work to do. Let’s keep doing what needs to be done now so we can return to a strong economy and normal day-to-day activities. For most Michiganders, that means continuing to practice masking and social distancing. For the Legislature, that means moving the billions in remaining federal dollars for Michigan out the door as quickly as possible.
House Bill 4049 is a reckless idea, poorly executed and poorly timed. I am vetoing it.
