A bill to amend 1994 PA 451, entitled

"Natural resources and environmental protection act,"

(MCL 324.101 to 324.90106) by adding section 5501b.

the people of the state of michigan enact:

Sec. 5501b. (1) Each individual has the right to breathable air.

(2) Each state department and agency shall employ all reasonable means to implement this section, including, but not limited to, adopting policies and grant criteria and promulgating rules to establish air quality criteria as appropriate. This subsection does not require an action that would adversely affect eligibility for federal funds.

(3) The department shall deny a permit under this part that would result in increased emissions and violate the right to breathable air.

Enacting section 1. This amendatory act shall be known and may be cited as the "breathable air act".
