CONTENT

 

The bill would repeal Public Act 302 of 1945, which specifies the emergency powers of the Governor.

 

(Public Act 302 allows the Governor to proclaim a state of emergency during times of "great public crisis, disaster, rioting, catastrophe, or similar public emergency" within the State and, after doing so, to promulgate reasonable orders, rules, and regulations to protect life and property and to bring the situation within the affected area under control. The Act specifies that the violation of any of those orders, rules, or regulations is punishable as a misdemeanor when the order, rule, or regulation states that a violation constitutes a misdemeanor.)

FISCAL IMPACT

 

The bill would have no fiscal impact on State or local government. Eliminating the Governor's powers to promulgate orders, rules, and regulations under the Act would not affect those powers that the Governor would continue to have under the Emergency Management Act, Public Act 390 of 1976.
