A bill to amend 1980 PA 299, entitled
"Occupational code,"
(MCL 339.101 to 339.2677) by adding section 1212.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1212. (1) Beginning 180 days after the effective date of
this section, as a condition for the renewal of an individual's
license as a service provider under this article, the individual
must complete 1 hour of continuing education about recognizing
indicators of domestic violence, sexual assault, and human
trafficking offered by a continuing education provider approved or
recognized by the department under section 207.
(2) An individual who is applying for the renewal of a license
as a service provider under this article shall certify his or her
compliance with subsection (1) to the department.
(3) The department by rule may establish requirements for
courses and instructors about recognizing indicators of domestic
violence, sexual assault, and human trafficking.
(4) If an individual who is licensed as a service provider
under this article completes the domestic violence, sexual assault,
and human trafficking indicators education described in this
section, the individual, or his or her employer, is not civilly or
criminally liable for acting in good faith or failing to act on
information obtained during the course of the individual's
employment concerning indicators of potential domestic violence,
sexual assault, or human trafficking.
(5) As used in this section:
(a) "Human trafficking" means that term as defined in section
2 of the human trafficking commission act, 2014 PA 325, MCL
752.972.
(b) "Service provider" means an individual who is licensed
under this article as any of the following:
(i) A cosmetologist.
(ii) An electrologist.
(iii) An esthetician.
(iv) A manicurist.
(v) A natural hair culturist.
(vi) An instructor.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
