A bill to amend 1937 PA 306, entitled
"An act to promote the safety, welfare, and educational interests
of the people of the state of Michigan by regulating the
construction, reconstruction, and remodeling of certain public or
private school buildings or additions to such buildings, by
regulating the construction, reconstruction, and remodeling of
buildings leased or acquired for school purposes, and to define the
class of buildings affected by this act; to prescribe the powers
and duties of certain state agencies and officials; to prescribe
penalties for the violation of this act; and to repeal acts and
parts of acts,"
(MCL 388.851 to 388.855a) by adding section 1c.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1c. (1) The department may develop or adopt policies and
procedures to ensure that all new and existing school buildings
meet LEED standards in lighting design to achieve maximum energy
efficiency and environmental sustainability, as described in
subsection (2).
(2) The policies and procedures developed or adopted under
subsection (1) shall conform to the following LEED standards to the
extent practicable:
(a) For new construction or a major renovation, the school
building must meet the LEED V4 BD+C standard for schools concerning
all of the following:
(i) Daylight. This standard is intended to connect building
occupants with the outdoors, reinforce circadian rhythms, and
reduce the use of electrical lighting by introducing daylight into
the space.
(ii) Quality views. This standard is intended to give building
occupants a connection to the natural outdoor environment by
providing quality views.
(iii) Light pollution reduction. This standard is intended to
increase night sky access, improve nighttime visibility, and reduce
the consequences of development for wildlife and people.
(iv) Interior lighting. This standard is intended to promote
occupants' productivity, comfort, and well-being by providing high-
quality lighting.
(b) For an existing structure that is not undergoing a major
renovation, the school building must meet the LEED V4 O+M standard
for schools concerning all of the following:
(i) Daylight and quality views. This standard is intended to
connect building occupants with the outdoors, reinforce circadian
rhythms, and reduce the use of electrical lighting by introducing
daylight and views into the space.
(ii) Light pollution reduction. This standard is intended to
increase night sky access, improve nighttime visibility, and reduce
the consequences of development for wildlife and people.
(iii) Interior lighting. This standard is intended to promote
occupants' productivity, comfort, and well-being by providing high-
quality lighting.
(3) If the department develops or adopts policies and
procedures under subsection (1), a public school shall comply with
the LEED standards described in subsection (2) unless the public
school provides notice to the department, in a form and manner
prescribed by the department, of constraints that limit the ability
of the public school to comply.
(4) A public school may demonstrate compliance with the LEED
standards described in subsection (2) by doing 1 of the following:
(a) Providing verification of compliance by a licensed
professional engineer with a current LEED professional credential
to the department, in a form and manner prescribed by the
department.
(b) Achieving a LEED certification for the LEED standards
described in subsection (2).
(5) As used in this section:
(a) "Department" means the department of licensing and
regulatory affairs.
(b) "LEED" means Leadership in Energy and Environmental
Design, a green building certification program developed and
managed by the U.S. Green Building Council.
(c) "Major renovation" means any building project at a school
building or proposed school building involving the modification of
an existing structure in which 25% or more of the physical
structure, facade, or interior space of a building is changed or
modified.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
