A bill to amend 1927 PA 175, entitled
"The code of criminal procedure,"
(MCL 760.1 to 777.69) by adding section 2 to chapter IX.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
CHAPTER IX
Sec. 2. In determining the appropriate sentence to be imposed
on a person who has been convicted of a crime, the court shall
consider as a mitigating circumstance the fact that the defendant
suffers from post-traumatic stress disorder, substance abuse, or
psychiatric or psychological problems resulting from service as a
member of the United States Armed Forces in a combat theater of
operations during a time of war or emergency.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
