A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding section 61528.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 61528. (1) Notwithstanding any other provision of this
act or the rules promulgated under this act, the department shall
not authorize the use of flowback water from hydraulic fracturing
for ice, snow, or dust control or for stabilization purposes, on
highways, roads, or streets.
(2) As used in this section, "hydraulic fracturing" means the
process of injecting foam or fluid in a well under pressure to
create fractures in a formation and thereby enhance production of
hydrocarbons.
