A bill to amend 1947 PA 336, entitled
"An act to prohibit strikes by certain public employees; to provide
review from disciplinary action with respect thereto; to provide
for the mediation of grievances and the holding of elections; to
declare and protect the rights and privileges of public employees;
to require certain provisions in collective bargaining agreements;
to prescribe means of enforcement and penalties for the violation
of the provisions of this act; and to make appropriations,"
(MCL 423.201 to 423.217) by amending the title, as amended by 2012
PA 53, and by adding section 15c.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
TITLE
An act to prohibit strikes by certain public employees; to
provide review from disciplinary action with respect thereto; to
provide for the mediation of grievances and the holding of
elections; to declare and protect the rights and privileges of
public employees; to require or prohibit certain provisions in
collective bargaining agreements; to prohibit certain subjects of
bargaining; to prescribe means of enforcement and penalties for the
violation of the provisions of this act; and to make
appropriations.
Sec. 15c. In a city with a population of 500,000 or more and a
bargaining unit of at least 1,000 public police department
employees, the subject of automatic entitlement to more favorable
terms and conditions of employment that are subsequently granted or
otherwise applied to that bargaining unit may not be negotiated
with any other bargaining unit of the public employer. If a public
employer and bargaining unit other than a bargaining unit of at
least 1,000 public police department employees include a provision
that purports to grant such an automatic entitlement in a
collective bargaining agreement entered into after the effective
date of this section, the provision is void. As used in this
section, "public police department employee" means an employee of
the city police department who is engaged as a police officer but
does not include an individual employed by a private company who
works under a contract with a governmental unit or an individual
whose duties are solely of an administrative or supporting nature.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
