COMMITTEE SUMMARY
House Bill 4177 (as passed by the House)
Sponsor: Representative Jim Ananich
House Committee: Criminal Justice
CONTENT
The bill would amend the Michigan Penal Code to refer to vulnerable adult abuse in the first or second degree, rather than the first and second degree, in a provision listing crimes that constitute first-degree murder.
Under the Penal Code, murder committed in the perpetration of, or attempt to perpetrate, any of the following is first-degree murder and must be punished by imprisonment for life:
-- Arson.
-- First-, second-, or third-degree criminal sexual conduct.
-- First-degree child abuse.
-- A major controlled substance offense.
-- Robbery.
-- Carjacking.
-- Breaking and entering of a dwelling.
-- First- or second-degree home invasion.
-- Larceny.
-- Extortion.
-- Kidnapping.
-- Torture.
-- Aggravated stalking.
-- First- and second-degree vulnerable adult abuse.
The bill would include first- or second-degree vulnerable adult abuse.

FISCAL IMPACT
Because the bill would simply clarify the language to make it consistent with the current Michigan Court of Appeals interpretation, the bill would have no fiscal impact on State or local government.
