     A bill to amend 1998 PA 58, entitled

 

"Michigan liquor control code of 1998,"

 

(MCL 436.1101 to 436.2303) by adding section 1026.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1026. (1) Beginning 120 days after the effective date of

 

the amendatory act that added this section, any licensee selling

 

any alcoholic liquor for consumption on the licensed premises shall

 

have available to the general public, on the licensed premises, a

 

self-operated device that provides a preliminary chemical breath

 

analysis. The device shall be a type approved by the commission.

 

     (2) Not later than 60 days after the effective date of the

 

amendatory act that added this subsection, the commission shall

 

provide to any licensee, upon request, a list of approved devices.

 

The commission shall also make the list of approved devices

 

available to the general public on its website.


 

     (3) The commission may promulgate rules under the

 

administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to

 

24.328, to implement this section.
