House Bill 5322 (Substitute S-1 as reported)

Sponsor:  Representative Kurt Heise

House Committee:  Judiciary

Senate Committee:  Outdoor Recreation and Tourism

CONTENT

The bill would amend Parts 401 (Wildlife Conservation) and 811 (Off-Road Recreation Vehicles) of the Natural Resources and Environmental Protection Act to allow an individual to take an animal from a vehicle and transport or possess an unloaded firearm in a vehicle on a sporting clays range.

Except as otherwise provided, Part 401 prohibits an individual from taking an animal from in or upon a vehicle.  Part 401 also prohibits an individual from transporting or possessing a firearm in or upon a vehicle, unless the firearm is unloaded in both barrel and magazine and enclosed in a case, carried in the trunk of a vehicle, or unloaded in a motorized boat.  The bill would create exceptions allowing a person to take an animal from a vehicle and transport or possess an unloaded firearm in or upon a vehicle on a sporting clays range.

Except as otherwise provided, Part 811 prohibits an individual from operating an off-road recreational vehicle while transporting a firearm unless unloaded and securely encased, or equipped with and made inoperative by a manufactured keylocked trigger housing mechanism.  The bill would create an exception to this prohibition for a person transporting or possessing an unloaded firearm on a sporting clays range.
