House Bill 5192 (Substitute S-3 as reported by the Committee of the Whole)
Sponsor: Representative Fred Durhal, Jr.
House Committee: Oversight, Reform, and Ethics
Senate Committee: Reforms, Restructuring and Reinventing

CONTENT
The bill would amend the public employment relations Act to revise language under which the selection of a retirant member of a municipality's fire and/or police pension board is a prohibited subject of collective bargaining.

Currently, if the charter of a city, village, or township with a population of 500,000 or more specifies the selection of a retirant member of the municipality's fire department, police department, or fire and police department pension or retirement board, the method of selection of that member is a prohibited subject of bargaining.

Under the bill, if the charter required and specified the method of selection of a retirant member, the inclusion of that member and the method of selection would be prohibited subjects of collective bargaining. Any provision in a collective bargaining agreement that purported to modify that charter requirement would be void.
