House Bill 4416 (as passed by the House)
Sponsor: Representative Frank Foster
House Committee: Judiciary
Senate Committee: Transportation
Date Completed: 6-20-11
CONTENT
The bill would amend the Michigan Vehicle Code to authorize a county to contract with a person who owns or is in charge of a private road open to the public to enforce the Code on that road.
The Code permits a city, township, or village to contract with a person who owns or is in charge of a private road that is open to the general public, at that person's request or with the person's consent, to enforce provisions of the Code on that road. The bill would extend the authority to enter into such a contract to counties.
Under the Code, a peace officer may enter upon the road to enforce the Code if the proper signs are posted on it. The owner or person in charge of the road is responsible for the cost and the posting of signs.

FISCAL IMPACT
The bill would increase both county revenue and expenses by an unknown and likely minimal amount. The magnitude of the changes would depend on how many owners of private roads chose to contract with counties to provide enforcement duties, the costs charged for those services, and the level of service contracted.
The bill would have no fiscal impact on State government.
