A SUMMARY OF HOUSE BILL 5936 AS ENROLLED
The bill would amend the Michigan Vehicle Code to permit the Secretary of State to waive requirements of a driving skills test for a person with military commercial motor vehicle experience if the applicant, at the time of application, certifies and provides satisfactory evidence to the Secretary of State that he or she continuously met all of the requirements under federal driver license standards during the two-year period preceding the date of the application for the commercial driver license.
Under the bill, if the Secretary of State determines through a governmental investigation, that there is reason to believe that a CDL or endorsement was issued as a result of fraudulent or improper conduct in taking a knowledge test or driving skills test required under federal law, the Secretary of State could require the applicant to retake and successfully pass the test. The Secretary of State would be required to cancel any CDL or endorsement listed as a result of the suspect test unless he or she retakes and passes that test.
