May 23, 2012

In accordance with MCL 333.7524a., I am pleased to present to the Michigan Legislature the 20th comprehensive report on asset forfeiture. Michigan’s asset forfeiture program saves taxpayer money and deprives drug criminals of cash and property obtained through illegal activity. Michigan’s law enforcement community has done an outstanding job of stripping drug dealers of illicit gain and utilizing these proceeds to expand and enhance drug enforcement efforts to protect our citizens.

During 2011, over $25.7 million in cash and assets amassed by drug traffickers was forfeited. Extensive multi-agency teamwork is evident in this report. Considerable assets were obtained as the result of joint enforcement involving many agencies at the federal, state, and local levels.

Forfeiture funds were used to enhance law enforcement by providing resources for personnel, needed equipment, canine expenses, prevention programs, and matching funds to obtain federal grants. Michigan’s recently amended Drug Forfeiture Statute allowed some agencies to contribute monies to non-profit drug-related criminal investigations, and obtain information for solving crimes.

I commend our law enforcement community for the tremendous job they have done and submit this report for your information and review.

Senator Young’s statement is as follows:

Madam President, I would like to start with a quote: “The excellence of every government is its adaptation to the state of those to be governed by it.” I think with this legislation we have clearly lost sight of adapting to the people and their interests.

I rise today to offer an amendment to this bill to address the issue of the Achievement Authority. My amendment removes any money from the foreclosure fraud settlement from being used to fund this entity. The purpose of this money is to help victims of foreclosure, not to further fund the takeover of Detroit Public Schools by a third party. We should not be further funding the Achievement Authority as it takes over publicly-owned buildings.

This legislation was funded out of the emergency manager act, which is illegal and unconstitutional. I don’t think that we should be further funding tyrannical regimes or educational takeovers. The entire settlement should be given directly to aid victims of foreclosure, not to further fund Governor Snyder’s special projects. This money would be better served helping the families who are now struggling because of foreclosure. Let’s use it for its intended purpose.

Protest

Senator Hood, under his constitutional right of protest (Art. 4, Sec. 18), protested against the passage of Senate Bill No. 871 and moved that the statement he made during the discussion of the bill be printed as his reasons for voting “no.”

Senator Hood’s statement is as follows:

There are a couple of concerns that I have with this legislation even though I know there are good things in it also. There are a couple of things, though, that need to be brought to your attention. Regarding the judiciary, there is $171,000 approximately for two additional Court of Appeals judges. Well, the Supreme Court Administrative Office did a Judicial Resources Recommendations report and have requested the elimination of these two positions, and we are going against that by putting these two positions back in. They should know better than us what they need to operate, and we should be more fiscally responsible in looking at and following their recommendations.

The other portion of this that concerns me is in the DNR portion where there is $300,000 for the Saginaw Valley Naval Museum. I think that everyone in here can go back to their districts or in their office have projects in which they would like funding. No disrespect to the Bay City area, but I think that we all have that.

We have had plenty of amendments come up in this chamber on both sides of the aisle where we have been told that there is no money. Plenty of times during the budget process we have heard that there is no money. We have also asked about the rainy day fund. Well, then the answer was let’s not go off and spend this money willy-nilly. That is the comment from a Senator.

I understand the necessity of having these projects in districts, but what was told to us is that this is not the time to just spend money all over the place. That was what was told. So my question is, then, why do we have this in here if we are looking to save money; if we are looking to bring this economy back around? Yes, it is only $300,000, but that is $300,000 that could be placed where we have been cutting programs like dental programs for children and all those other things.

So right now I question whether or not this is the right time to do this when we are cutting vital resources to our citizens of the state of Michigan. With that, I will state that there are good things in this bill that I do support wholeheartedly, but those are the things that I don’t support, and that is why I will be voting “no” on this legislation.

Senate Resolution No. 158.

A resolution to urge the President of the United States to declare a major disaster or emergency for areas in Michigan’s Upper Peninsula impacted by the Duck Lake wildfire.

Whereas, The Duck Lake fire in Luce County, Michigan, began May 24, 2012, following a lightning strike. As of June 6, the wildfire has covered 21,112 acres and destroyed 49 cabins and homes, including a motel and store, 23 garages, 38 sheds, and 26 campers; and

Whereas, The Duck Lake fire is now the third-largest forest fire to ever burn in the history of the great state of Michigan; and

Whereas, Governor Snyder declared a state of disaster in Luce and Schoolcraft Counties on May 25, 2012, to make all state resources available to fight the fire. In addition, Governor Snyder activated the National Guard to provide assistance; and

Whereas, The Michigan Department of Natural Resources, in cooperation with state and local partners, has fought in dangerous conditions against the wildfire to protect people, property, and Michigan’s natural resources. One hundred fifty-six people, 16 engines, 5 bulldozers, 4 hand crews, and 1 fixed-wing aircraft have been employed to stop the fire. The tireless and selfless efforts of the professional personnel, countless volunteers, and laypersons helped avert even further property damage and prevented the loss of life; and

Whereas, Federal assistance is necessary to supplement state efforts and resources. Michigan’s third-largest wildfire has caused extensive damage and irreparably changed people’s lives. Every means available will be needed to help residents rebuild their communities, homes, and businesses; now, therefore, be it

Resolved by the Senate, That we urge the President of the United States to declare a major disaster or emergency for areas in Michigan’s Upper Peninsula impacted by the Duck Lake wildfire; and be it further

Resolved, That copies of this resolution be transmitted to the President of the United States, the regional administrator of the Federal Emergency Management Agency, the members of the Michigan congressional delegation, and the Office of the Governor.
