“O Lord God Our Father, we thank You for Your never-ending love for us. We thank You that You have given us these stunning peninsulas that we call home: Michigan. We treasure its beauty….and thus we treasure You Our God….every time we look around us. We thank You that You call these legislators to serve our good people of Michigan…..and we thank You for the people of Michigan: a people of every race, language and creed…..

We bless You for the opportunity to serve in these challenging days. Grant to us the wisdom to make the hard decisions….grant us the wisdom to know how to craft legislation that will truly help our people.

Help us God our Creator to care for the needs of all Your people…..help us to make decisions that give hope to the hopeless….and compassion to the vulnerable.

In Your kindness You have given us these good people to serve our Michigan…..be their shepherd and their guide. House Resolution No. 137.

A resolution to declare October 2011 as Breast Cancer Awareness Month in the state of Michigan.

Whereas, October has long been recognized across America as Breast Cancer Awareness Month in an effort to raise public awareness about the importance of early detection; and

Whereas, In 2011, it is estimated that among U.S. women, there will be 230,480 new cases of invasive breast cancer and 57,650 new cases of in situ breast cancer along with 39,520 breast cancer deaths; and

Whereas, According to the Michigan Department of Community Health, breast cancer is the second leading cause of cancer deaths in Michigan and the most commonly diagnosed cancer in Michigan women; and

Whereas, In 2010, 7,340 women in Michigan were newly diagnosed with invasive breast cancer and 1,320 women died of the disease; and

Whereas, The five year survival rate among women whose breast cancer has not spread beyond the breast at the time of diagnosis is 98.3 percent; and

Whereas, All women are at risk for breast cancer and the two most important risk factors are being female and getting older; and

Whereas, Since the inception of Breast Cancer Awareness month in 1985, mammography use across America has doubled and breast cancer death rates have declined; and

Whereas, Efforts to promote increased mammography screening have resulted in the third Friday in October being declared National Mammography Day; and

Whereas, Even with impressive progress, many women do not utilize mammography at regular intervals, despite the fact that mammography is the best available method of detecting breast changes that may be cancer, long before physical symptoms can be seen or felt, and that breast cancer deaths could decline further if all women age 40 and older received mammograms at regular intervals; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body declare October 2011 as Breast Cancer Awareness Month in Michigan; and be it further

Resolved, That the members of this legislative body urge all Michiganders to use this month as an opportunity to educate themselves about breast cancer and take proactive steps to reduce their risk and get appropriate screening.

A resolution to declare October 6, 2011, as Read For The Record Day in the state of Michigan.

Whereas, Millions of children in low-income neighborhoods are at risk of school failure before they even start kindergarten; and

Whereas, Jumpstart’s Read for the Record® allows Americans to demand that all children receive the quality early education they deserve; and

Whereas, In 2010, a record of reading to 2,057,513 children was set and Jumpstart aims to break that record; and

Whereas, The official campaign book this year is Anna Dewdney’s Llama Llama Red Pajama; and

Whereas, On October 6, 2011, more than 2 million voices will call for an end to America’s early education achievement gap by reading Llama Llama Red Pajama by Anna Dewdney – setting a new world record in the process; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body declare October 6, 2011, as Read For The Record Day in the state of Michigan.

“An act to authorize certain local governmental units to incorporate municipal health facilities corporations and subsidiary municipal health facilities corporations for establishing, modifying, operating, and managing health services and acquiring, constructing, adding to, repairing, remodeling, renovating, equipping, and re-equipping hospitals and other health care facilities and related purposes; to provide for the application of this act to existing municipal hospitals and for the transfer of ownership of hospital funds and personal property; to validate and ratify the existence, organization, actions, proceedings, and board membership of existing organizations acting as county public hospitals; to provide for the appointment of trustees; to grant certain powers of a public body corporate to health facilities corporations and subsidiary health facilities corporations; to empower certain local governmental units to encumber property for the benefit of, transfer or make property available to, issue bonds to construct facilities to be used by, appropriate funds for, and levy a tax for, municipal health facilities corporations and subsidiary municipal health facilities corporations; to empower certain local governmental units to guarantee obligations of municipal health facilities corporations and subsidiary municipal health facilities corporations and to permit certain local governmental units to pledge their full faith and credit to pay such guaranties; to provide for transfer of ownership or operation of health care facilities and health services to nonprofit health care organizations; to authorize municipal health facilities corporations and subsidiary municipal health facilities corporations to borrow money and issue notes for the purposes of meeting expenses of operation and to issue corporation obligations for the purpose of acquisition, construction, repair, remodeling, equipping or re-equipping of health care facilities and for the refinancing, refunding, or refunding in advance of indebtedness of the municipal health facilities corporations or the subsidiary municipal health facilities corporations or of indebtedness of certain local governmental units undertaken on their behalf; to authorize municipal health facilities corporations and subsidiary municipal health facilities corporations to enter into mortgages, deeds of trust, and other agreements for security which may include provisions for the appointment of receivers; to exempt obligations and property of municipal health facilities corporations and subsidiary municipal health facilities corporations from taxation; and to provide other rights, powers, and duties of municipal health facilities corporations and subsidiary municipal health facilities corporations,”

A bill to amend 1957 PA 261, entitled “Michigan legislative retirement system act,” by amending section 75 (MCL 38.1075), as amended by 1998 PA 501.

(The bill was received from the Senate on October 5, with substitute (S-2), title amendment and immediate effect given by the Senate, consideration of which, under the rules, was postponed until today, see House Journal No. 77, p. 2347.)

Rep. Geiss moved to amend the Senate substitute (S-2) as follows:

1. Amend page 1, following “THE PEOPLE OF THE STATE OF MICHIGAN ENACT:” by inserting:

“Sec. 50b. (1) For EXCEPT AS OTHERWISE PROVIDED IN THIS SECTION, FOR a retirant or a survivor or beneficiary of a deceased retirant, or for a deferred vested member if that deferred vested member first became a member on or before January 1, 1995, the retirement system shall purchase and pay the premium for hospitalization and medical insurance coverage and dental and vision coverage for the retirant, deferred vested member, and the spouses, eligible children, and survivors of those retirants and deferred vested members. Except as otherwise provided in this section, the retirement system shall provide hospitalization and medical insurance coverage and dental and vision insurance coverage under this section at a level that is equal to or greater than the level of insurance coverage under this section in effect on December 1, 1992. The retirement board may increase the amounts each person who is enrolled in insurance coverage under this section is required to pay for co-pays or deductibles under that insurance coverage.

(2) On and after March 31, 1997, the retirement system shall also pay health insurance premiums described in this section in the manner prescribed in section 79.

(3) NOTWITHSTANDING ANY PROVISION OF THIS ACT TO THE CONTRARY, BEGINNING ON THE EFFECTIVE DATE OF THE AMENDATORY ACT THAT ADDED THIS SUBSECTION, THE RETIREMENT SYSTEM SHALL NOT PURCHASE AND PAY THE PREMIUM FOR HOSPITALIZATION AND MEDICAL INSURANCE COVERAGE OR DENTAL AND VISION COVERAGE FOR A RETIRANT, A DEFERRED VESTED MEMBER, OR THE SPOUSE, ELIGIBLE CHILD, OR SURVIVOR OF A RETIRANT OR DEFERRED VESTED MEMBER UNLESS THE RETIRANT OR DEFERRED VESTED MEMBER HAS COMPLETED 30 YEARS OF SERVICE AS A MEMBER.”.

2. Amend page 2, line 4, after “completed” by striking out “6” and inserting “30”.

3. Amend page 2, line 10, after “has” by striking out the balance of the subdivision and inserting “COMPLETED 30 YEARS OF SERVICE AS A MEMBER.”.

4. Amend page 2, line 20, after “completed” by striking out “5” and inserting “30”.

The motion did not prevail and the amendments were not adopted, a majority of the members serving not voting therefor.

I opposed SB 670 because it is claimed to be a technical fix when it is not one at all. This bill would require an undue burden on life insurance annuity companies requiring them to remit and withhold taxes computed in the state of Michigan for pensioners, but more importantly it is an enormous burden on our Seniors. There are no rules in Treasury to deal with this right now, and the companies to do not have the technology yet to compute this and our new pension tax.”
