     A bill to authorize the department of natural resources to

 

convey certain state owned property in Iosco county; to prescribe

 

conditions for the conveyance; and to provide for disposition of

 

the revenue from the conveyance.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. The department of natural resources, on behalf of the

 

state, shall convey to Boyd S. Aldridge and Loretta S. Aldridge,

 

husband and wife, for fair market value as determined under section

 

3, certain property under the jurisdiction of the department of

 

natural resources and located in Oscoda township, Iosco county,

 

Michigan, and further described as follows:

 

BEGINNING AT THE CORNER COMMON TO SECTIONS 4 AND 5 ON NORTH COUNTY

 

LINE, T24N, R9E, OSCODA TOWNSHIP, IOSCO COUNTY, MICHIGAN ; THENCE

 

NORTH 89°58'16" EAST, ALONG NORTH LINE OF SAID SECTION 4, AND

 


CENTERLINE OF KINGS CORNER ROAD, 1300.14 FEET; THENCE SOUTH

 

00°25'53" WEST, ALONG EAST LINE OF THE WEST 1/2 OF THE NORTHWEST

 

1/4 OF SAID SECTION 4, 2642.99 FEET; THENCE SOUTH 00°25'53" WEST,

 

ALONG EAST LINE OF THE WEST 1/2 OF THE SOUTHWEST 1/4 OF SAID

NORTH-SOUTH 1/4 LINE, 1291 FEET MORE OR LESS; THENCE NORTH

 

89°24'17" WEST, ALONG SOUTH LINE OF NORTH 1/2 OF SOUTHWEST 1/4 OF

CENTERLINE OF KINGS CORNER ROAD, 700.00 FEET TO THE POINT OF

 

BEGINNING. THE ABOVE DESCRIBED PARCEL BEING THE WEST 1/4 OF SAID

 

SECTION 4 AND A PART OF THE EAST 1/4 OF SAID SECTION 5, AND PART OF

 

WEST 1/2 OF SAID SECTION 9, AND PART OF THE EAST 1/2 OF THE

 

NORTHEAST 1/4 OF SAID SECTION 8, AND CONTAINS 475 ACRES OF LAND,

 

MORE OR LESS. BEING SUBJECT TO THE RIGHTS OF THE PUBLIC OVER THE

 

NORTHERLY 33 FEET THEREOF FOR KINGS CORNER ROAD. ALSO BEING SUBJECT

 

TO EASEMENTS AND/OR RESTRICTIONS OF RECORD IF ANY.

 


     Sec. 2. The description of the parcel in section 1 is

 

approximate and for purposes of the conveyance is subject to

 

adjustments as the department of natural resources or the attorney

 

general considers necessary by survey or legal description.

 

     Sec. 3. The fair market value of the property described in

 

section 1 shall be determined by an appraisal prepared for the

 

department of natural resources by an independent appraiser.

 

     Sec. 4. The conveyance authorized by this act shall be by

 

quitclaim deed approved by the attorney general and shall reserve

 

all rights in aboriginal antiquities, including mounds, earthworks,

 

forts, burial and village sites, mines, or other relics, including

 

the right to explore and excavate for the aboriginal antiquity by

 

the state or its authorized agents.

 

     Sec. 5. The state shall not reserve oil, gas, or mineral

 

rights to the property conveyed under this act. However, the

 

conveyance authorized under this act shall provide that, if the

 

purchaser of any grantee develops any oil, gas, or minerals found

 

on, within, or under the conveyed property, the purchaser or any

 

grantee shall pay the state 1/2 of the gross revenue generated from

 

the development of the oil, gas, or minerals. This payment shall be

 

deposited in the general fund.

 

     Sec. 6. The revenue received under this act shall be deposited

 

in the state treasury and credited to the general fund.
