SUBSTITUTE FOR

HOUSE BILL NO. 5145

     A bill to amend 1956 PA 218, entitled

"The insurance code of 1956,"

(MCL 500.100 to 500.8302) by adding section 2026c.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

     Sec. 2026c. (1) If a violation by an insurer of section 3149

or section 2203 is the second or subsequent violation of that

section by the insurer, after notice and an opportunity for a

hearing and on order of the commissioner, the insurer is subject to

an administrative fine of $1,000,000.00.

     (2) The commissioner shall deposit a fine paid under this

section into the insurance whistleblower protection fund created in

section 2035a.

     Enacting section 1. This amendatory act does not take effect

unless all of the following bills of the 95th Legislature are

enacted into law:

     (a) House Bill No. 4244.

     (b) House Bill No. 4844.

     (c) House Bill No. 5020.

     (d) House Bill No. 5146.

     (e) House Bill No. 5147.

     (f) House Bill No. 5148.

     (g) House Bill No. 5150.

     (h) House Bill No. 5151.
