A bill to amend 1949 PA 300, entitled “An act to provide for the registration, titling, sale, transfer, and regulation of certain vehicles operated upon the public highways of this state or any other place open to the general public or generally accessible to motor vehicles and distressed vehicles; to provide for the licensing of dealers; to provide for the examination, licensing, and control of operators and chauffeurs; to provide for the giving of proof of financial responsibility and security by owners and operators of vehicles; to provide for the imposition, levy, and collection of specific taxes on vehicles, and the levy and collection of sales and use taxes, license fees, and permit fees; to provide for the regulation and use of streets and highways; to create certain funds; to provide penalties and sanctions for a violation of this act; to provide for civil liability of owners and operators of vehicles and service of process on residents and nonresidents; to regulate the introduction and use of certain evidence; to provide for the levy of certain assessments; to provide for the enforcement of this act; to provide for the creation of and to prescribe the powers and duties of certain state and local agencies; to impose liability upon the state or local agencies; to provide appropriations for certain purposes; to repeal all other acts or parts of acts inconsistent with this act or contrary to this act; and to repeal certain parts of this act on a specific date,” by amending sections 732, 907, and 909 (MCL 257.732, 257.907, and 257.909), section 732 as amended by 2006 PA 298, section 907 as amended by 2008 PA 463, and section 909 as amended by 2000 PA 94.

Rep. Miller, having reserved the right to explain his protest against the passage of the bill, made the following statement:

“Mr. Speaker and members of the House:

In light of the Auditor General’s recent report detailing less-than-accurate monitoring, administration, and reported benefit of many of the state’s economic development incentives including Brownfield Redevelopment credits, I cannot support extending this program. The foregone revenue is needed to fund early childhood education and other important programs or at the least make the tax burden fair to all taxpayers instead of just those who have the connections to get the Brownfield credits.”

Rep. Bledsoe offered the following resolution:

House Resolution No. 264.

A resolution to declare April 2010 as Student Athlete Cardiac Awareness Month in the state of Michigan.

Whereas, There have been at least 41 deaths of student athletes due to sudden cardiac arrest and related causes in the state of Michigan since December of 1999; and

Whereas, One of those students was 15-year old Kimberly Anne Gillary, whose life was tragically lost as a result of a sudden cardiac arrest in a high school water polo game on April 1, 2000; and

Whereas, The Gillary family founded the Kimberly Anne Gillary Foundation in April, 2000 in Kimberly’s memory to donate Automated External Defibrillators (AEDs) to Michigan high schools and to advocate cardiac screening and testing of all Michigan high school student athletes; and

Whereas, As of February 1, 2010, the Kimberly Anne Gillary Foundation has raised more than $1 million and has donated more than 500 AEDs to Michigan high schools; and

Whereas, There have been at least two lives saved using AEDs donated by the Kimberly Anne Gillary Foundation to Michigan high schools: On October 24, 2007, the life of 17-year old Ashley Palmer was saved at Davison High School due to the quick thinking and training of Davison High School staff members after Ashley suffered a sudden cardiac arrest; and on April 22, 2009, 67-year old Larry Ratkowski was saved at Hamilton High School while a spectator at a high school baseball game due to the quick thinking and training of the Hamilton High School Principal, the Athletic Trainer, one of the students, and a Deputy Sheriff; and

Whereas, In large part as a result of the efforts of the Kimberly Anne Gillary Foundation, approximately 75% of the high schools in Michigan now have at least one AED and staff members trained in CPR and the use of an AED, and there is an increased awareness of the importance of more effective pre-participation cardiac screening of our high school student athletes and of having AEDs readily accessible in Michigan high schools; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body declare April 2010 as Student Athlete Cardiac Awareness Month in the state of Michigan; and be it further

Resolved, That the people of the state of Michigan are hereby encouraged to become more aware of the importance of improved pre-participation screening of our student athletes and of the preparedness of our citizenry and public employees to respond to the sudden cardiac arrest of our sons and daughters while entrusted to our public schools in the course of our sons’ and daughters’ education; and be it further

Resolved, That we encourage the Michigan High School Athletic Association to implement nationally applied standards for the pre-screening of prospective student athletes for conditions that may put them at risk of cardiac arrest.

House Resolution No. 265.

A resolution declaring the week of April 26 through May 2, 2010, as Michigan School Counselors’ Week.

Whereas, Governor Granholm has declared the week of April 26, 2010 through May 2, 2010, as Michigan School Counselors’ Week; and

Whereas, The House of Representatives has recognized the importance of school counseling through the inclusion of elementary and secondary school counseling programs in Michigan schools; and

Whereas, Michigan School Counselors have long emphasized the importance of personal and social development and academic achievement; and

Whereas, Michigan School Counselors help develop well-rounded students by guiding them through their academic, personal, social and career development; and

Whereas, Michigan School Counselors play a vital role in ensuring that students are aware of financial aid and college opportunities; and

Whereas, Michigan School Counselors may encourage students to pursue challenging academic courses to prepare them for college majors and careers in science, technology, engineering and mathematics fields; and

Whereas, Michigan School Counselors help students cope with the serious and common challenges of growing up, including peer pressure, mental health issues, school violence, disciplinary problems, the deployment of family members to conflicts overseas and problems in the home; and

Whereas, Michigan School Counselors are also instrumental in helping students, teachers and parents deal with personal trauma and community and national tragedies; and

Whereas, Michigan School Counselors are among the few professionals in a school building that are trained both in education and mental health; and

Whereas, Despite the important contributions of school counselors to student success, counseling positions are not always protected when budgets are cut; and

Whereas, The average student-to-counselor ratio in Michigan public schools is 634-to-1, which is almost triple the 250-to-1 ratio recommended by the American School Counselor Association, the American Counseling Association, the American Medical Association, the American Psychological Association and other organizations; and

Whereas, The celebration of Michigan School Counselors’ Week would increase awareness of the important and necessary role Michigan School Counselors play in the lives of students in Michigan; and

Whereas, It is important to acknowledge the role school counselors play in cultivating our most important resource, Michigan’s children; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body declare the week of April 26 through May 2, 2010, as Michigan School Counselors’ Week.

House Resolution No. 266.

A resolution to declare the week of May 10 to May 16, 2010, as Senior Housing Awareness Week in the state of Michigan.

Whereas, It is essential that elderly adults of Michigan be able to find suitable and appropriate housing for their special needs; and

Whereas, The need for housing for older residents will grow as the aging population grows; and

Whereas, Locating appropriate housing is a time-consuming and difficult process; and

Whereas, Information is power. The better informed our older citizens are about a wide range of housing choices, the better their decisions about where to live will be; and

Whereas, May is Older Adults Month; and

Whereas, Senior Housing Awareness Week is an opportunity to raise awareness in Michigan of appropriate and affordable housing for our older citizens; and

Whereas, The state of Michigan wishes to commend and promote our many fine facilities that currently house many older citizens; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body declare the week of May 10 through May 16, 2010, as Senior Housing Awareness Week in the state of Michigan; and be it further

Resolved, That the Housing Bureau for Seniors of Washtenaw County be commended for promoting this effort and that a copy of this resolution be transmitted to the Housing Bureau for Seniors.

House Resolution No. 267.

A resolution to declare May 25, 2010, as Missing Children’s Day in the state of Michigan.

Whereas, According to the U.S. Department of Justice, in one year there were an estimated nearly 800,000 children missing; and

Whereas, On average, there is an estimated average of 2,200 children reported missing to law enforcement agencies daily; and

Whereas, 58,200 of these children are victims of non-family abductions and more than 200,000 are the victims of family abductions; and

Whereas, The National Center for Missing & Exploited Children® (NCMEC) exists as a resource to help prevent child abduction and sexual exploitation; help find missing children; and assist victims of child abduction and sexual exploitation, their families, and the professionals who serve them. The National Center for Missing & Exploited Children’s recovery rate has grown from 62% in 1990 to 96% of domestically missing children, but too many children still remain among the missing; and

Whereas, This special day is a time to remember those children who are missing and give hope to their families; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body declare May 25, 2010, as Missing Children’s Day in the state of Michigan; and be it further

Resolved, That we urge the participation of local government, law enforcement, schools, community-based organizations, and families in the protection and education of all individuals about child abduction and sexual exploitation, appropriate protective measures, and ways to respond and seek help from law enforcement, social services, and the National Center for Missing & Exploited Children.
