A bill to amend 1976 PA 331, entitled
"Michigan consumer protection act,"
(MCL 445.901 to 445.922) by adding section 3f.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 3f. A person engaged in the retail sale of goods or
services shall not do any of the following in connection with a
gift certificate for retail goods or services:
(a) Sell a gift certificate to a consumer that states an
expiration date or otherwise expires. This subdivision does not
apply to a gift certificate given without charge to a consumer for
advertising or sales promotion purposes.
(b) Charge an inactivity fee or other service fee to a
consumer when he or she uses a gift certificate.
Enacting section 1. This amendatory act does not take effect
unless House Bill No. 4317 of the 94th Legislature is enacted into
law.
