Senate Bill 1077 (Substitute S-4 as reported by the Committee of the Whole)
Sponsor: Senator Mike Prusi
Committee: Natural Resources and Environmental Affairs
CONTENT
The bill would amend Public Act 290 of 2008, which authorizes the owner of livestock to remove, capture, or kill a gray wolf that is preying on the livestock, to provide that sections of the Act containing this authorization, prescribing procedures, and setting penalties for violations, would not be operational and enforceable until one of the following occurred:
-- A final appellate court issued a decision overruling the decision of the U.S. District Court for the District of Columbia in The Humane Society of the United States v Dirk Kempthorne (No. 07-0677, 9-29-08) and permitted the final rule of the U.S. Fish and Wildlife Service removing gray wolves in Michigan from the list of endangered and threatened wildlife to take effect.
-- The U.S. Fish and Wildlife Service promulgated a final rule dated after March 12, 2007, that removed gray wolves in Michigan from the list of endangered and threatened wildlife and that final rule took effect.
When the affected sections of the Act became operational and enforceable, the Department of Natural Resources would have to post on its website a notice that included the date the sections were operational and effective, and a summary of the provisions of those sections.
