SENATE BILL No. 1243

     A bill to amend 1976 PA 388, entitled

 

"Michigan campaign finance act,"

 

(MCL 169.201 to 169.282) by adding section 32a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 32a. (1) Except as provided in subsection (5), a

 

candidate committee shall report a contribution within 7 business

 

days of receiving the contribution. The contribution shall be

 

reported in the form required by the secretary of state. A report

 

under this subsection shall contain the information required by

 

section 26(1)(e), (g), and (h) and (6) for the contribution.

 

     (2) Except as provided in subsection (5), a candidate

 

committee shall report an expenditure within 10 business days of

 

making the expenditure. The expenditure shall be reported in the

 

form required by the secretary of state. A report under this


 

subsection shall contain the information required by section

 

26(1)(j) and (3) for the expenditure.

 

     (3) A report under this section may report multiple

 

contributions or expenditures on the same form, shall contain the

 

information required by section 26(1)(a), and shall be filed with

 

the officials designated in section 36 to receive the committee's

 

campaign statements.

 

     (4) Reporting a contribution or expenditure under this section

 

does not excuse other reporting of the contribution or expenditure

 

in a campaign statement or otherwise as required by this act.

 

     (5) A candidate committee that files a written statement under

 

section 24(5) need not file a report under this section unless it

 

has received or expended an amount in excess of $1,000.00. If the

 

committee receives or expends an amount in excess of $1,000.00, the

 

committee is then subject to this section.

 

     (6) A candidate committee, candidate, treasurer, or other

 

individual designated as responsible for the committee's record

 

keeping, report preparation, or report filing who fails to file a

 

report as required by this section shall pay a late filing fee, not

 

to exceed $2,000.00, determined as follows:

 

     (a) Twenty-five dollars for each business day the report

 

remains unfiled.

 

     (b) An additional $25.00 for each business day after the first

 

3 business days the report remains unfiled.

 

     (c) An additional $50.00 for each business day after the first

 

10 business days the report remains unfiled.
