HOUSE BILL No. 6421

 

September 6, 2006, Introduced by Reps. Kooiman, Farhat, Proos, Vander Veen, Green, Booher, Stahl, Hansen, Moolenaar, Gillard, Lipsey, Sheen, Hoogendyk, Hildenbrand, Huizenga, Walker, Pearce, Wenke, Shaffer, Caul, Kahn, Nitz, Palsrok and Ball and referred to the Committee on Transportation.

 

     A bill to amend 1964 PA 286, entitled

 

"An act to provide for the organization, powers, and duties of the

state transportation commission and the state transportation

department; to provide for the appointment, powers, and duties of

the state transportation director; to abolish the office of state

highway commissioner and the commissioner's advisory board and to

transfer their powers and duties; to provide for penalties and

remedies; and to repeal certain acts and parts of acts,"

 

by amending section 3 (MCL 247.803).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 3. (1) The governor with the advice and consent of the

 

senate shall appoint the first members of the commission for terms

 

of 1, 2, 3, and 4 years, commencing on July 1, 1964. Except for

 

terms commenced before the effective date of section 6a, the term

 

of office of a member of the commission shall be for 3 years.

 

Vacancies on the commission shall be filled by the governor for the

 

unexpired terms. Each member shall give to the people of the state

 


a bond in the penal sum of $25,000.00, with sureties approved by

 

the state treasurer, conditioned upon the faithful discharge of the

 

duties of his or her office, the premium to be paid from the state

 

transportation fund.

 

     (2) The governor shall appoint commission members to assure

 

that the commissioners are selected equitably among the department

 

of transportation regions. To assure equitable geographic

 

representation, the governor shall appoint no more than 2

 

commissioners from any 1 transportation region.
