A bill to amend 1931 PA 328, entitled
"The Michigan penal code,"
(MCL 750.1 to 750.568) by adding section 411u.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 411u. (1) A lessor of rental property who knowingly
allows the manufacture, delivery, or possession of controlled
substances, as described in subsection (2), to be conducted by
another person on or in the rental property is guilty of a
misdemeanor punishable by imprisonment for not more than 180 days
or a fine of not more than $5,000.00, or both.
(2) Subsection (1) applies to the following prohibited acts:
(a) A violation described in section 7401(2)(a)(i), (ii), or
(iii) of the public health code, 1978 PA 368, MCL 333.7401.
(b) A violation described in section 7403(2)(a)(i), (ii), or
(iii) of the public health code, 1978 PA 368, MCL 333.7403.
(3) As used in this section:
(a) "Lessor" means a person who owns rental property and
allows the rental property to be occupied by another for an agreed
upon consideration.
(b) "Rental property" means a structure or part of a structure
intended for residential or commercial use, and includes
appurtenant grounds that are intended for use by the occupant.
