A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding section 21737.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 21737. (1) A nursing home shall not be licensed under
this part unless the nursing home is fully sprinklered.
(2) Within 6 months after the effective date of this section,
a nursing home licensed under this part that is not fully
sprinklered shall, in accordance with the fire prevention code,
1941 PA 207, MCL 29.1 to 29.34, submit detailed plans and
specifications of the installation of a fire suppression system or
the retrofitting of its current system to the state fire marshal
and provide the department, upon request, copies of the same. Not
later than 1 year after the effective date of this section, each of
those nursing homes shall have an automatic fire suppression system
installed on each floor that is approved by the state fire marshal.
(3) Subsections (1) and (2) do not apply unless congress
enacts the nursing home fire safety act of 2005 or other similar
legislation, as determined by the department, creating a funding
mechanism for fire sprinkler retrofitting in nursing homes.
Subsections (1) and (2) do not apply until 90 days after the
effective date of such federal legislation or 90 days after the
effective date of the amendatory act that added this section,
whichever is later.
