A bill to authorize local units of government to levy a tax
for the purpose of operating and maintaining storm water utility
systems.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. As used in this act:
(a) "Local unit of government" means a county, city, village,
or township.
(b) "Storm water utility system" means storm sewers, retention
basins, and all other appurtenances and attachments necessary to
the system.
Sec. 2. (1) A local unit of government may establish a storm
water utility system. If approved by a majority of the qualified
electors of that local unit of government voting on the proposal at
a regular or special election, the local unit of government may
levy a tax to pay for capital, operating, and maintenance costs of
a storm water utility system. The tax shall not exceed 5 mills on
the taxable value of all taxable property in the local unit of
government and shall be levied and collected under the general
property tax act, 1893 PA 206, MCL 211.1 to 211.157.
(2) The tax levied under this act shall be in addition to any
statutory or charter tax rate limitation.
