A bill to require departments and regulatory agencies of this
state to acknowledge timely receipt of information requests
submitted by mail as the postmark date; and to provide for rule-
making authority.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. This act shall be known and may be cited as the
"postmark acknowledgment act".
Sec. 2. As used in this act:
(a) "Information submission" means information required to be
submitted by a regulated person to a regulatory agency through use
of the United States postal service.
(b) "Regulated person" means an individual or legal entity
subject to the authority of a regulatory agency.
(c) "Regulatory agency" means a department, bureau, or agency
of this state that has statutory regulatory authority over
activities of an individual, business, profession, or industry.
Sec. 3. Except as otherwise provided for by law or as
otherwise required by a rule promulgated before the effective date
of this act, a regulatory agency shall accept and acknowledge the
postmark date as the date of receipt of an information submission
made by a regulated person.
Sec. 4. Except as otherwise provided for by law, a regulatory
agency may promulgate rules or amend existing rules under the
administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to
24.328, to implement this act.
Sec. 5. This act takes effect October 1, 2006.
