A bill to amend 1990 PA 187, entitled
"The pupil transportation act,"
(MCL 257.1801 to 257.1877) by adding section 40.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 40. (1) The department of state police shall commission a
pilot study to determine the amount of diesel particulate matter in
the air of diesel-powered school buses while the buses are
transporting students to or from a school. The study shall include
a review of studies conducted and regulations imposed in other
states and the evaluation of possible control mechanisms,
including, but not limited to, the imposition of a no-idling policy
for school buses under certain circumstances. The department may
contract with a competent agency or private entity that is
qualified to conduct the study prescribed in subsection (2).
(2) The pilot study shall include testing sufficient air
samples in both kind and number that conform with generally
accepted scientific methods. The study shall also include samples
from a geographical cross-section of the state, including samples
from buses in urban and rural school districts and from
economically diverse school districts.
(3) The department of state police shall report the results of
the pilot study to the legislature and the department of education
within 1 year after the effective date of the amendatory act that
added this section. In addition, the results of the pilot study
reported to the legislature shall be posted on the websites of the
department of state police and the department of education.
