HOUSE BILL No. 4203

     A bill to amend 1984 PA 431, entitled

 

"The management and budget act,"

 

(MCL 18.1101 to 18.1594) by adding section 241c.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 241c. (1) The department shall require that each contract

 

entered into for construction, alteration, repair, or rebuilding of

 

a state building or other state property shall contain a clause

 

requiring that the persons working on the project employed by the

 

contractor or subcontractor of the contractor are not required to

 

do any of the following:

 

     (a) To become a member of or affiliated with a labor

 

organization as a condition of working on the project.

 


     (b) To pay dues or fees to a labor organization, over an

 

employee's objection, in excess of the employee's share of labor

 

organization costs relating to collective bargaining, contract

 

administration, or grievance adjustment as a condition of working

 

on the contract.

 

     (2) A unit of local government that receives state funds for

 

the construction, alteration, repair, or rebuilding of a building

 

or other property owned or operated by the unit of local

 

government, as a condition of receiving those state funds, shall

 

require that each contract for that construction, alteration,

 

repair, or rebuilding shall contain a clause requiring that the

 

persons working on the project employed by the contractor or

 

subcontractor of the contractor are not required to do any of the

 

following:

 

     (a) To become a member of or affiliated with a labor

 

organization as a condition of working on the project.

 

     (b) To pay dues or fees to a labor organization, over an

 

employee's objection, in excess of the employee's share of labor

 

organization costs relating to collective bargaining, contract

 

administration, or grievance adjustment as a condition of working
