SUBSTITUTE FOR

 

HOUSE BILL NO. 5580

 

 

 

 

 

 

 

 

 

 

 

 

     A bill to amend 1954 PA 116, entitled

 

"Michigan election law,"

 

by amending sections 24c and 24d (MCL 168.24c and 168.24d).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 24c. (1) Selection of the members of  such  the board of

 

county canvassers shall be made from each of the 2 political

 

parties casting the greatest number of votes for secretary of state

 

at the preceding general November election in that county.  No  A

 

political party shall not be represented by more than 2 members on

 

the board of county canvassers at any  one  1 time.

 

     (2) The county committee of each political party, not later

 

than September 1, 1963 and not later than September 1 of each odd

 

numbered year thereafter, shall submit to the county clerk the

names of 3 interested persons for each position to which the party

 

is entitled. In  any  a county having 2 or more congressional

 

districts within its boundaries, the  chairmen  chairpersons of the

 

congressional district committees shall act as the county committee

 

for the purposes of  sections 24c and 24d of this act  this section

 

and section 24d and shall select  one  1 of their number to act as

 

chairman  chairperson for  such  these purposes.

 

     (3) The county board of  supervisors  commissioners, within 10

 

days after convening for their annual meeting, shall elect by

 

ballot to each position  one  1 of the 3  persons nominated  

 

nominees for the position, and the board  thereupon  shall appoint

 

the person to the position. Before electing a nominee to the board

 

of county canvassers under this subsection, the county board of

 

commissioners may request that a nominee provide any of the

 

following in order to determine whether the nominee is qualified

 

for and interested in the position on the board of county

 

canvassers:

 

     (a) A letter signed by the nominee indicating an interest in

 

serving on the board of county canvassers and indicating an intent

 

to discharge the duties of the position on the board of county

 

canvassers to the best of his or her ability.

 

     (b) Prior election experience including canvassing elections.

 

     (c) Information on whether the nominee has been convicted of a

 

felony or election crime.

     (4) Failure of the county board of  supervisors  commissioners

 


to appoint  one  1 of the  persons nominated  nominees for  any  a

 

position on the board of county canvassers within 10 days after

 

convening for their annual meeting shall result in a vacancy

 

existing in the position,  and  which shall be filled as  

 

hereinafter  provided in section 24d for the filling of vacancies

 

on the board of county canvassers.

 

     Sec. 24d. (1)  Whenever  If a vacancy occurs in the membership

 

of the board of county canvassers, the county clerk shall

 

immediately give notice  forthwith  of the vacancy to the  chairman  

 

chairperson of the county committee of the political party entitled

 

to fill the vacancy.

 

     (2) The county committee of the political party entitled to

 

fill  any  a vacancy on the board of county canvassers, within 10

 

days after receiving information concerning  such  the vacancy,

 

shall nominate 3 interested persons for the position and submit the

 

list of nominees to the county clerk.  who  

 

     (3) The county clerk, within 10 days from receipt of the

 

nomination  list of nominees, shall appoint  one  1 of the  persons

 

so nominated. Any  nominees to the board of county canvassers.

 

Before appointing a nominee to the board of county canvassers under

 

this subsection, the county clerk may request that a nominee

 

provide any of the following in order to determine whether the

 

nominee is qualified for and interested in the position on the

 

board of county canvassers:

 

     (a) A letter signed by the nominee indicating an interest in

 

serving on the board of county canvassers and indicating an intent

 

to discharge the duties of the position on the board of county

     (4) A person appointed to fill a vacancy on the board of

 

county canvassers shall serve for the balance of the unexpired

 

term.
