SUBSTITUTE FOR

 

HOUSE BILL NO. 4800

 

 

 

 

 

 

 

 

 

 

 

 

     A bill to amend 1961 PA 236, entitled

 

"Revised judicature act of 1961,"

 

by amending section 8311 (MCL 600.8311).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 8311.  The  Except as otherwise provided by law, the

 

district court  shall have  has jurisdiction of all of the

 

following:

 

     (a) Misdemeanors punishable by a fine or imprisonment not

 

exceeding 1 year, or both.

 

     (b) Ordinance and charter violations punishable by a fine or

 

imprisonment, or both.

 

     (c) Arraignments,  the  fixing  of  bail, and  the  accepting  

 

of  bonds.

     (d) Preliminary examinations in all felony cases charged

 

before August 1, 2006 and in misdemeanor cases not  cognizable by

 

the district court, but there  described in subdivision (a) or (b)

 

charged before August 1, 2006. There shall not be a preliminary

 

examination for any misdemeanor to be tried in  a  the district

 

court.

     [(e) Beginning august 1, 2006, Preliminary examinations ordered under section 1(6) of chapter VI of the code of criminal procedure, 1927 PA 175, MCL 766.1.

     (F)] Beginning August 1, 2006, conferences under section 1(3)

 

of chapter VI of the code of criminal procedure, 1927 PA 175, MCL

 

766.1.

 

     [(g)] Beginning August 1, 2006, pleas in felony cases and in

 

misdemeanor cases not described in subdivision (a) or (b) that are

 

made before the information is filed in circuit court. However,

 

sentencing for a plea taken under this subdivision shall be in the

 

circuit court.

 

     Enacting section 1. This amendatory act takes effect August 1,

 

2006.

 

     Enacting section 2. This amendatory act does not take effect

 

unless all of the following bills of the 93rd Legislature are

 

enacted into law:

 

     (a) House Bill No. 4796.

 

     (b) House Bill No. 4799.
