CONTENT
The bill would amend the Administrative Procedures Act to require the State Office of Administrative Hearings and Rules (SOAHR) to file an electronic copy of promulgated rules with the Secretary of State, along with the copies SOAHR is currently required to file. Additionally, the bill would require that the Secretary of State transmit an electronic copy, instead of a paper copy, of rules filed in his or her office to the Secretary of the Senate and the Clerk of the House.
Under the Act, to promulgate a rule, SOAHR must file in the office of the Secretary of State three copies of the rule bearing the required certificates of approval and adoption, and true copies of the rule without the certificates. Under the bill, SOAHR also would have to file one electronic copy.
The Act provides that the Secretary of State must transmit, after copies of rules are filed in his or her office, a paper copy on which the day and hour of that filing have been indorsed, as follows:
-- To the secretary of the Joint Committee on Administrative Rules (JCAR) and SOAHR.
-- To the Secretary of the Senate and the Clerk of the House of Representatives for distribution by them to each member of the Senate and the House of Representatives.
The bill would require the Secretary of State to transmit an electronic copy (rather than a paper copy) to the Secretary of the Senate and the Clerk of the House for distribution or transmittal by them to each member of the Senate and the House. The Secretary of State would have to send a paper copy to the JCAR secretary and SOAHR, as presently required.

FISCAL IMPACT
The bill would result in savings to the Department of State and other executive offices that currently provide paper copies of rules. The Department of Labor and Economic Growth estimates annual savings to that Department of $4,000 from reduced printing requirements.
