A SUMMARY OF HOUSE BILL 5676 AS INTRODUCED 2-14-06

Currently under the law, the Department of Natural Resources may order the removal or relocation of an anchored raft that presents a hazard to navigation.  House Bill 5676 would amend the Natural Resources and Environmental Protection Act to specify that a peace officer also may order removal or relocation of a hazardous anchored raft.

Under the act, "peace officer" is defined [at MCL 324.80104(c)] to mean any of the following:   a sheriff, a sheriff's deputy, or a deputy who is authorized by a sheriff to enforce the Natural Resources Management Part of the Natural Resources and Environmental Protection Act, and who has satisfactorily completed at least 40 hours of law enforcement training, including training specific to natural resources; a village or township marshal; an officer of the police department of any municipality; an officer of the Michigan State Police; or the director of the Department of Natural Resources and conservation officers employed by the department.
