As we ponder the affairs of the state today, help us to never forget what our purpose is here and that purpose being, to represent the people of the state of Michigan. Give us the wisdom to make the correct decisions and give us the strength to follow through on those decisions. Father, now as we go about those deliberations, we ask for Your blessings on this session. We pray in Thy heavenly name, Amen."

Senate Concurrent Resolution No. 45.

A concurrent resolution to create the Joint Select Committee on Economic Growth.

Whereas, The single business tax, which was adopted in 1975, replaced a host of other business taxes with a modified value added system that was unique in its scope. The tax has been modified numerous times over the course of the years to make it friendlier to business, but these changes have never completely quelled the negative characteristics of the tax. In fact, the changes have ultimately distorted its value added nature, made it more complex, and, arguably, made it an even larger deterrent to economic activity and business recruitment in the state; and

Whereas, The single business tax has been reviled as being an odious, destructive, and onerous tax long overdue for replacement. Indeed, in 1999, legislation was adopted to phase out the tax over a 23-year period. This timetable was changed by 2002 PA 531 to eliminate the tax after December 31, 2009; and

Whereas, An initiative petition to repeal the single business tax on December 31, 2007 has been filed with the Secretary of State. Once the petition signatures have been verified, the Legislature, as set out in the Constitution, must either enact or reject the single business tax repeal without change or amendment; and

Whereas, The single business tax stymies business growth and the state's economic development efforts since it taxes jobs, taxes health care, and taxes businesses that do not turn a profit. Replacing the single business tax with a business tax that is more equitable, less complex, and more conducive to business recruitment, retention, and expansion and the associated job creation is one of Michigan's most pressing needs, as the future of our state and its economy is at a critical junction. Business tax replacement requires immediate and determined action by the Legislature to assure that good tax policy will be responsible public policy; now, therefore, be it

Resolved by the Senate (the House of Representatives concurring), That we hereby create the Joint Select Committee on Economic Growth. The joint select committee will be comprised of 3 members of the Senate appointed by the Senate Majority Leader in the same manner as standing committees in the Senate are appointed, and 3 members of the House of Representatives appointed by the Speaker of the House in the same manner as standing committees in the House of Representatives are appointed. The joint select committee shall report its findings and recommendations to the Legislature; and be it further

Resolved, That the joint select committee shall examine methods of business taxation that are conducive to business recruitment, retention, and expansion and the associated jobs that are created. The joint select committee shall also consider mechanisms to protect the integrity of the current tax credits including brownfield redevelopment, MEGA job creation and retention activity, expansion of venture capital in Michigan, business activity within Michigan's numerous renaissance zones, and similar economic development tools. The joint select committee, with the assistance of the directors of the Senate Fiscal Agency and the House Fiscal Agency, shall also examine ways to allow the agencies access to all business taxpayer information relevant to the development of a replacement business tax while providing adequate protection against inappropriate disclosure; and be it further

Resolved, That the joint select committee is hereby authorized to expend a maximum of $10,000 in carrying out its duties and such additional expenditures deemed necessary by the chair of the committee and approved by the Senate Majority Leader and the Speaker of the House of Representatives. Payments for contractual services may be authorized by the committee chair, the Senate Majority Leader, and the Speaker of the House of Representatives.

The Senate has adopted the concurrent resolution.

"An act to protect the environment and natural resources of the state; to codify, revise, consolidate, and classify laws relating to the environment and natural resources of the state; to regulate the discharge of certain substances into the environment; to regulate the use of certain lands, waters, and other natural resources of the state; to prescribe the powers and duties of certain state and local agencies and officials; to provide for certain charges, fees, assessments, and donations; to provide certain appropriations; to prescribe penalties and provide remedies; and to repeal acts and parts of acts,"

Rep. Alma Smith, having reserved the right to explain her protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I voted 'no' because methane digesters used as a means of cleaning the environment fall far short of addressing the real problems of pollution caused by concentrated animal feed operations. This process will not eliminate most of the antibiotic, heavy metal or hormone pollutants from animal waste generated at industrial livestock operation and yields only minor reductions in pathogens. When spread on the fields these contaminants will continue to have a serious impact on our ground water and, allowed to runoff, degrade the quality of our surface water. I also voted 'no' because this bill originally excluded facilities with civil violations of $10,000 or more from participating in the low interest loan program. It no longer does.

I also voted 'no' on SB 538 because I object to using very limited state dollars to subsidize questionable 'technology'. This tax exemption would benefit only operations large enough to use a methane digester, usually multimillion-dollar concentrated animal feed operations. Taxpayers should not be expected to subsidize them and to use the pollution prevention revolving loan fund perverts its original purpose of helping small businesses. The expense of properly disposing of these vast amounts of manure generated at factory farms should be a cost of doing business."

Rep. Kathleen Law, having reserved the right to explain her protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I voted no on SB 538 because the language which would ensure that proven polluters are not eligible for these loans was removed from this House substituted version. This version of SB538 allows for more competition from an already competitive funding source while providing no new money. Methane digester technology is not new, has not proven to be cost effective or efficient, and does not provide the necessary protection from pathogen or bacterial exposure. The end result of the anaerobic process used in methane digestion is a manure which is devoid of nutrient value, very difficult to dewater and can only be burned or landfilled, both of which are hardly an improvement on our efforts to reduce the amount of waste which goes to landfills."

House Resolution No. 271.

A resolution to memorialize the United States Congress to reverse the planned cuts in the Pell Grant program.

Whereas, Since 1972, federal Pell Grants have enabled the children of low-income and working-class Americans to enter college and achieve the American dream. About a third of Americans in college, some 5.3 million students, receive grants from the $13 billion program. The average grant of $2,400 per year takes a bite out of the rapidly rising college tuition bills that currently average over $5,000 for a public four-year college. Add the cost of fees, room, and board, and the price more than doubles; and

Whereas, The federal Department of Education has recalculated the eligibility formulas by using 2002 tax rates instead of the 1990 rates. Congress allowed this revision in an omnibus spending bill which the American Council of Education estimates will affect all 1.3 million students receiving grants, including 90,000 who will not get any money at all in the coming year. While the change will save the government $300 million annually, an estimated 90% of the students receiving these grants are from families earning less than $35,000 per year. The grant reductions will increasingly squeeze middle-income families trying to send their children to college; and

Whereas, Even assuming that the 2002 tables are more up-to-date than the 1990 tables, changes in state taxation levels since 2002 may make even the updated tables misleading. The bigger picture is that Pell Grants cover only a small portion of the college education bill. With costs rising rapidly, more families who could only barely afford this vital path to prosperity may find that their hopes of climbing up another rung on the economic ladder must be postponed another generation. In our rapidly changing economy where education is the key to adapting, we should not hinder the chance of young people to pursue the American dream; now, therefore, be it

Resolved by the House of Representatives, That we memorialize the United States Congress to reverse the planned cuts in the Pell Grant program; and be it further

Resolved, That copies of this resolution be transmitted to the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.
