A bill to amend 1970 PA 29, entitled "An act relating to potatoes; to create a potato commission; to prescribe its powers and duties and authority; to impose an assessment on the privilege of introducing potatoes into the channels of trade and commerce; to provide for the collection of the assessment; to provide for penalties; and to repeal certain acts and parts of acts," by amending section 2 (MCL 290.422), as amended by 2000 PA 5.

A resolution declaring May 2005 as Asian Pacific American Heritage Month in the state of Michigan.
Whereas, The state of Michigan is fortunate to have nearly 180,000 citizens of Asian and Pacific Island descent among its population. They have made, and continue to make, significant contributions to our society. Individuals of Asian and Pacific Island origin have migrated to Michigan from over 30 nations and are excelling in the fields of education, business, arts, and other various professions; and
Whereas, The dedication and commitment of our Great Lakes state's Asian Pacific American citizens is best reflected in the establishment of many Asian Pacific American organizations such as the Asian Pacific American Chamber of Commerce, the Council of Asian Pacific Americans, Asian American Citizens for Justice, the Asian Pacific American Women's Association, the Mid-Michigan Asian Pacific American Association, and the Asian American Bar Association; and
Whereas, Asian Pacific American citizens, through advocating issues of justice and equity, continue to break down the barriers of discrimination, indifference, and intolerance, thereby making it possible for all Asian Pacific Americans to move to the forefront of social, cultural, political, and economic arenas; and
Whereas, The state of Michigan is proud of its cultural diversity and welcomes the opportunity to honor our Asian Pacific American citizens for their commitment to leadership, dedication to knowledge, and determination to succeed; now, therefore, be it
Resolved by the House of Representatives, That the members of this legislative body declare May 2005 as Asian Pacific American Heritage Month in the state of Michigan. We urge all citizens to recognize the many accomplishments and contributions that Asian Pacific Americans have made to our state, nation, and world.

A resolution recognizing May 4, 2005, as Aces With-a-Friend at the Capitol Day.
Whereas, The President's Council on Physical Fitness and Sports has designated the month of May 2005 as National Physical Fitness and Sports Month; and
Whereas, National Physical Fitness and Sports Month is our country's observance of fitness and sports. Many agencies have initiated programs designed to improve our quality of life; and
Whereas, ACES With-a-Friend stands for All Children Exercising Simultaneously and encourages schools to invite parents and others to join the fun; and
Whereas, ACES With-a-Friend was founded in 1989. All 50 states and more than 50 countries are active participants in the program; and
Whereas, ACES With-a-Friend is endorsed by the President's Council on Physical Fitness and Sports and the Michigan Governor's Council on Physical Fitness and Sports; and
Whereas, In 2002, the state of Michigan set the record for the most participants in an individual state; and
Whereas, Regular physical activity can have a significant impact on lifelong health and ACES With-a-Friend encourages students to be more physically active; and
Whereas, On Wednesday, May 4, 2005, students from across Michigan will be participating in ACES With-a-Friend at the State Capitol; now, therefore, be it

House Resolution No. 73.
A resolution to memorialize the United States Congress to oppose the continuation of all provisions of the USA PATRIOT Act which infringe upon individuals' civil liberties and which are set to expire in 2005.
Whereas, The citizens of the state of Michigan honor the Constitution of the United States as the protector of the rights of the individual, including the right to assemble and the right to free speech; and
Whereas, The state of Michigan is home to citizens of many nationalities and religions, including many who immigrated to this land in search of the American standards of life, liberty, and the pursuit of happiness; and
Whereas, Terrorist attacks against the United States should not be tolerated, and federal, state and local governments should use all powers they are granted to prevent further attacks from occurring; and
Whereas, In this great nation, citizens can expect their government to both keep them safe from harm and protect their individual liberties and freedoms; and
Whereas, There are provisions in the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act, also known as the USA PATRIOT Act of 2001, that threaten the system of checks and balances that this nation was founded upon and obstruct citizens' constitutionally protected rights to freedom of speech, freedom of assembly, freedom from unreasonable search and seizure, and entitlement to due process and equal protection under the law, specifically:
(1) Section 213, which allows law enforcement agents to enter a home or office and perform a search without notifying the resident of their presence;
(2) Section 215, which provides the Federal Bureau of Investigation with the power to request a secret court order for "any tangible thing" from a business or organization, such as library records, by telling the court the investigation is related to terrorism, while not allowing the court to investigate the matter;
(3) Section 411, which greatly expands the government's power to detain and deport immigrants, based on scant empirical evidence;
(4) Section 412, which allows for the indefinite detention of non-US citizens, even if they are never charged with a crime;
(5) Section 505, which allows the Attorney General to request an individual's records from a third party with little judicial oversight and no requirement that the individual be suspected of terrorism;
(6) Sections 507 and 508, which allow highly personal student records to be transmitted to law enforcement with no suspicion of wrong-doing;
(7) Section 802, which greatly expands the definition of "domestic terrorism" to include acts that "...appear to be intended to intimidate or coerce a civilian population"; and
(8) Section 805, which so broadly prohibits an individual's right to provide advice or assistance to any group designated by the U.S. Government to be a foreign terrorist organization that one can be prosecuted for providing medical assistance to children
; and
Whereas, It is the policy of the state of Michigan to uphold the state and federal constitutions by protecting the rights and liberties of the people of this state. We strongly support the goal of the administration to punish all groups and individuals responsible for the terrorist attacks of September 11, 2001, and to prevent similar attacks against United States citizens from occurring in the future; now, therefore, be it
Resolved by the House of Representatives, That we memorialize the United States Congress to oppose the continuation of all provisions of the USA PATRIOT Act which infringe upon individuals' civil liberties and which are set to expire in 2005; and be it further
Resolved, That copies of this resolution be transmitted to the Office of the President of the United States, the Attorney General of the United States, the Office of the Governor, the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.
The resolution was referred to the Committee on Government Operations.

Senate Concurrent Resolution No. 17, entitled
A concurrent resolution to urge the United States Coast Guard to immediately eliminate the "No Ballast on Board" (NOBOB) exemption from regulations on ballast water management and require all ships with ballast tanks that enter the Great Lakes to conform to all regulations for ballast water management in federal law.
Whereas, Great Lakes waters are among the most valuable natural resources in the world, vital to the economy and environment of the state; and
Whereas, More than 160 species of aquatic invasive plants and animals have been introduced into the Great Lakes. Several species, including the sea lamprey, zebra mussel, round goby, and purple loosestrife, have impaired Michigan's environment, affecting recreational and commercial fishing, beaches, municipal and industrial water supplies, coastal habitat, and fundamental ecosystems in the Great Lakes; and
Whereas, Many of these species have been accidentally introduced from foreign ports by discharge from ships' ballast tanks. There are many more species from all over the world that may still be introduced and pose a threat to the Great Lakes; and
Whereas, Most ships enter the Great Lakes through the St. Lawrence Seaway fully loaded, carrying no ballast, and are designated no ballast on board (NOBOB); and
Whereas, NOBOB ships are exempted by rule of the United States Coast Guard from meeting regulations under the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990, as amended by the National Invasive Species Act of 1996. These regulations require ships with ballast to meet certain requirements for best management practices regarding ballast water, including exchange of ballast water on the open ocean; and
Whereas, NOBOB ships are still carrying unpumpable water and sediments in ballast tanks that will be mixed with Great Lakes water and pumped out while the vessels are transiting the lakes; and
Whereas, This mixture may contain aquatic invasive species from foreign ports that could be discharged into the Great Lakes; and
Whereas, The Michigan Department of Environmental Quality petitioned the United States Coast Guard on July 14, 2004, seeking to end the exemption from federal ballast water regulations for NOBOB ships; and
Whereas, The United States Coast Guard has published in the Federal Register, pages 1448-1449 of Volume 70:5, a notice for consultation with all interested parties in identifying ballast water management strategies for NOBOB vessels entering the Great Lakes; now, therefore, be it
Resolved by the Senate (the House of Representatives concurring), That we urge the United States Coast Guard to immediately eliminate the "No Ballast on Board" (NOBOB) exemption from regulations on ballast water management and require all ships with ballast tanks that enter the Great Lakes to conform to all regulations for ballast water management in federal law; and be it further
Resolved, A copy of this resolution be transmitted to the United States Coast Guard and the United States Department of Transportation.
The Senate has adopted the concurrent resolution.
