A bill to amend 1976 PA 451, entitled
"The revised school code,"
by amending section 1231 (MCL 380.1231), as amended by 2002 PA
735.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1231. (1) The board of a school district shall hire
2 and contract with qualified teachers. Contracts with teachers
3 shall be in writing and signed on behalf of the school district
4 by a majority of the board, by the president and secretary of the
5 board, or by the superintendent of schools or an authorized
6 representative of the board. The contracts shall specify the
7 wages agreed upon.
8 (2) A teacher's contract shall be filed with the secretary of
9 the board and a duplicate copy of the contract shall be furnished
10 to the teacher.
1 (3) Except as otherwise provided under this act, a contract
2 with a teacher is not valid unless the person holds a valid
3 teaching certificate at the time the contractual period begins.
4 A contract shall terminate if the certificate expires by
5 limitation and is not renewed immediately or if it is suspended
6 or revoked by proper legal authority.
7 (4) The board of a school district, after a teacher has been
8 employed at least 2 consecutive years by the board, may enter
9 into a continuing contract with a certificated teacher.
10 (5) If a teacher is under contract with a school district as
11 of July 1 of a specific year, the board of another school
12 district or the board of directors of a public school academy
13 shall not hire the teacher after that July 1 for all or part of
14 the next school year unless the board or board of directors first
15 obtains the written consent of the school district with which the
16 teacher is under contract.
17 (6) (5) As
used in this section, "teacher" does not include
18 a substitute teacher.
