A bill to amend 1976 PA 451, entitled
"The revised school code,"
(MCL 380.1 to 380.1852) by adding section 1531d.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1531d. (1) Beginning July 1, 2003, the superintendent
2 of public instruction shall not issue an initial teaching
3 certificate to a person unless the person presents evidence
4 satisfactory to the superintendent of public instruction that the
5 person meets 1 of the following:
6 (a) Has successfully completed a course approved by the
7 department in cardiopulmonary resuscitation, including a test
8 demonstration on a mannequin, and has successfully completed
9 instruction approved by the department in foreign body airway
10 obstruction management, and holds valid certification in these
11 topics issued by the American red cross, American heart
1 association, or a comparable organization or institution approved
2 by the department.
3 (b) Has physical limitations that make it impracticable for
4 the person to complete the instruction and obtain the required
5 certification under subdivision (a).
6 (2) A person who meets the requirements described in
7 subsection (1)(a) and who performs cardiopulmonary resuscitation
8 or foreign body airway obstruction management on another person
9 in the course of his or her employment as a teacher is not liable
10 in a civil action for damages resulting from an act or omission
11 occurring in that performance except an act or omission
12 constituting gross negligence or willful and wanton misconduct.
