A bill to amend 1949 PA 300, entitled
"Michigan vehicle code,"
by amending section 684 (MCL 257.684).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 684. (a)
Every vehicle upon a highway within this
2 state at any time from
a half hour after sunset to a half hour
3 before sunrise and at
any other time when there is not sufficient
4 light to render
clearly discernible persons and vehicles on the
5 highway at a distance
of 500 feet ahead shall display lighted
6 lamps and illuminating
devices as hereinafter respectively
7 required for different
classes of vehicles, subject to exceptions
8 with respect to parked
vehicles as hereinafter stated. When
9 lighted lamps and
illuminated devices are required by law no
10 vehicle shall be
operated upon any highway of this state with
11 only the parking
lights illuminated on the front of the vehicle.
1 (b) Whenever
requirement is hereinafter declared as to the
2 distance from which
certain lamps and devices shall render
3 objects visible or
within which such lamps or devices shall be
4 visible, said
provisions shall apply during the times stated in
5 paragraph (a) of this
section upon a straight, level, unlighted
6 highway under normal
atmospheric conditions unless a different
7 time or condition is
expressly stated.
8 (c) Whenever
requirement is hereinafter declared as to the
9 mounted height of
lamps or devices, it shall mean from the center
10 of such lamp or device
to the level ground upon which the vehicle
11 stands when such
vehicle is without a load.
12 (1) A motor vehicle being driven upon a highway in this
13 state shall display lighted headlamps under any of the following
14 circumstances:
15 (a) Between 1/2 hour after sunset to 1/2 hour before
16 sunrise.
17 (b) When there is insufficient light to render clearly
18 discernible persons and vehicles on a highway at a distance of
19 500 feet.
20 (c) During a time when precipitation is present causing the
21 driver of a motor vehicle to operate the vehicle's windshield
22 wiper.
23 (2) The distance prescribed under subsection (1)(b) applies
24 on a straight, level, unlighted portion of a highway under normal
25 atmospheric conditions.
26 (3) The height requirement of a lamp required under this act
27 shall be measured from the center of the lamp to level ground on
1 which the vehicle stands when the vehicle is without a load.
2 (4) An individual who drives a motor vehicle in violation of
3 this section is responsible for a civil infraction.
