                                                                                 A bill to amend 1994 PA 451, entitled                                             

                                                                                

    "Natural resources and environmental protection act,"                       

                                                                                

    (MCL 324.101 to 324.90106) by adding part 413.                              

                                                                                

                THE PEOPLE OF THE STATE OF MICHIGAN ENACT:                      

                                                                                

1                      PART 413 NONNATIVE ORGANISMS                             

                                                                                

2       Sec. 41301.  As used in this part, "prohibited species"                     

                                                                                

3   means any of the following or the eggs thereof:                             

                                                                                

4       (a) Bighead carp (Hypophthalmichthys nobilis) or a hybrid                   

                                                                                

5   thereof.                                                                    

                                                                                

6       (b) Bitterling (Rhodeus sericeus) or a hybrid thereof.                      

                                                                                

7       (c) Black carp (Mylopharyngodon piceus) or a hybrid thereof.                

                                                                                

8       (d) Grass carp (Ctenopharyngodon idellus) or a hybrid                       

                                                                                

9   thereof.                                                                    

                                                                                

10      (e) Ide (Leuciscus idus) or a hybrid thereof.                               

                                                                                

11      (f) Japanese weatherfish (Misgurnus anguillicaudatus) or a                  

                                                                                


                                                                                

1   hybrid thereof.                                                             

                                                                                

2       (g) Rudd (Scardinius erythrophthalamus) or a hybrid thereof.                

                                                                                

3       (h) Silver carp (Hypophthalmichthys molitrix) or a hybrid                   

                                                                                

4   thereof.                                                                    

                                                                                

5       (i) A fish of the snakehead family (family Channidae).                      

                                                                                

6       (j) Tench (Tinca tinca) or a hybrid thereof.                                

                                                                                

7       Sec. 41303.  A person shall not possess or release a live                   

                                                                                

8   prohibited species.                                                         

                                                                                

9       Sec. 41305.  A person who violates this part is guilty of a                 

                                                                                

10  felony punishable by imprisonment for not more than 5 years or a            

                                                                                

11  fine of not more than $250,000.00, or both.  In addition, the               

                                                                                

12  court shall order the person to reimburse this state for damages            

                                                                                

13  to the natural resources of this state resulting from the                   

                                                                                

14  violation and costs incurred to prevent or minimize such damages.
