A SUMMARY OF HOUSE BILL 4135 AS INTRODUCED 2-4-03

House Bill 4135 would amend the Michigan Vehicle Code to specify that notwithstanding any other provision in the code, a person who was responsible for a violation of a speed limit on a street or highway in a residence district would be subject to a fine that was double the amount otherwise prescribed for that violation.

Under the code, the speed limit in residence districts can be no faster than 25 miles an hour, and must be slower whenever that speed is unsafe. A person who violates this provision of the law is responsible for a civil infraction, and fines are set at the discretion of the local courts within certain parameters. The act defines "residence district" at MCL 257.51 to mean the territory contiguous to a highway not comprising a business district when the frontage on such highway for a distance of 300 feet or more is mainly occupied by dwellings or by dwellings and buildings in use for business.
