"Mr. Speaker and members of the House:

I voted no on the Hardman amendment regarding the health of the mother because I believe that the Vander Veen amendment better delineates the situations speaking to the physical health of the mother as well as protecting the unborn child."

 

Rep. Richardville, having reserved the right to explain his nay vote, made the following statement:

"Mr. Speaker and members of the House:

I voted no on the Hardman amendment regarding the health of the mother because I believe that the Vander Veen amendment that better delineates the situations speaking to the physical health of the mother as well as protecting the unborn child."

 

Rep. Robertson moved to amend the bill as follows:

1. Amend page 3, following line 2, by inserting:

"(iv) Umbilical cord pulsation.".

The motion prevailed and the amendment was adopted, a majority of the members serving voting therefor.

 

Reps. Vander Veen and Tabor moved to amend the bill as follows:

1. Amend page 2, line 13, after "perinate" by striking out the balance of the subsection and inserting "under any of the following circumstances:

(a) If the perinate is being expelled from the mother's body as a result of a spontaneous abortion.

(b) If in that physician's reasonable medical judgment and in compliance with the applicable standard of practice and care, the procedure was necessary in either of the following circumstances:

(i) To save the life of the mother and every reasonable effort was made to preserve the life of both the mother and the perinate.

(ii) To avert an imminent threat to the physical health of the mother, and any harm to the perinate was incidental to treating the mother and not a known or intended result of the procedure performed.".

2. Amend page 2, following line 24, by inserting:

"(b) "Imminent threat to the physical health" means a physical condition that if left untreated would result in substantial and irreversible impairment of a major bodily function." and relettering the remaining subdivisions.

The motion prevailed and the amendments were adopted, a majority of the members serving voting therefor.

Reps. Accavitti, Murphy, Law, Zelenko, Meisner, Adamini, Byrum, Whitmer, Hardman, Minore, Anderson, Williams, Farrah, Dennis, Vagnozzi, Waters, Condino, Elkins, Gillard and Hopgood, having reserved the right to explain their protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I voted 'No' on House Bill 4603 (H-1) because it threatens women's health. The Michigan State Medical Society and the Michigan Section of the American College of Obstetricians and Gynecologists oppose this bill because it tries to legislatively define medical practices instead of allowing trained physicians to make medical decisions in the best interest of their patients. This bill could have adverse effects on women suffering miscarriages and women faced with a non-viable fetus in the late stages of pregnancy by requiring physicians to do everything possible to preserve the life of a 'perinate' without consideration for the health and well-being of the woman. Physicians are supposed to be our trusted confidents and act in the best interest of our health, but with this bill, politics would be put before sound medical decisions. Government does not belong in our medical exam rooms. I also opposed this bill because it again defies consistent United States Supreme Court rulings that when a state restricts access to abortion, a woman's health must be the paramount consideration. This will be the third time that Michigan has tried to pass a bill that does not meet the criteria outlined by previous decisions of the United States Supreme Court that a woman's health must be protected. House Bill 4603 (H-1) is unconstitutional and threatens the health of the mother by trying to legislatively define medical practices as opposed to allowing physicians to practice what is in the best interest of their patients. This bill is just one of the latest examples of divide-and-conquer politics and it is a clear attempt to attack the Governor rather than advancing sound public policy. Women deserve the best medical treatment that they can receive-treatment that is based on their best interest as defined by trained medical professionals and not by politics."

 

Rep. Kolb, having reserved the right to explain his protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I voted 'No' on House Bill 4603 (H-1) because it threatens women's health. This bill is just one of the latest examples of divide-and-conquer politics and it is a clear attempt to attack the Governor, and all those who stand to protect a woman's constitutional right to receive the best medical care for her, rather than advancing sound public policy."

 

Rep. Tobocman, having reserved the right to explain his protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I voted 'No' on House Bill 4603 (H-1) because it threatens women's health. The Michigan State Medical Society and the Michigan Section of the American College of Obstetricians and Gynecologists oppose this bill because it tries to legislatively define medical practices instead of allowing trained physicians to make medical decisions in the best interest of their patients. This bill could have adverse effects on women suffering miscarriages and women faced with a non-viable fetus in the late stages of pregnancy by requiring physicians to do everything possible to preserve the life of a 'perinate' without consideration for the health and well-being of the woman. Women deserve the best medical treatment that they can receive-treatment that is based on their best interest as defined by trained medical professionals and not by politics. Michigan citizens deserve better than to have their tax dollars wasted in legal costs to defend political views that fall outside of what is permitted by the United States Constitution."

A resolution to memorialize the Congress of the United States to restore proposed cuts to the 21st Century Community Learning Centers program for after-school programs.

Whereas, The proposed federal budget includes a $400 million cut in the 21st Century Community Learning Centers program for after-school programs; and

Whereas, The proposed cut undermines the goals of the "No Child Left Behind" Act to help children succeed academically and enhance their reading and writing skills; and

Whereas, The proposed cut would directly affect programming for over 20,000 high-risk youth in Michigan, through an estimated $15,688,256 loss of funding; and

Whereas, Many research studies indicate that children who consistently attend after-school programs have better peer relations, emotional adjustment, conflict resolution skills, grades, and conduct compared to those children not involved in programs; and

Whereas, Juvenile crime soars in the hours immediately after the bell rings, and after-school programs prevent juvenile delinquency and victimization of youth; and

Whereas, 21st Century Community Learning Centers actively engage parents as partners in their children's education and seek to strengthen the bonds between home and school; and

Whereas, 21st Century Community Learning Centers in Michigan are successful in reducing school absenteeism, improving reading scores, and providing a safe place for children during peak juvenile crime hours; and

Whereas, 21st Century Community Learning Centers align their curriculum with the school day curriculum through fun and experimental learning activities; and

Whereas, The state of Michigan has begun the implementation of the 21st Century Community Learning Centers and sees these centers as one of the best sustainable means to offer quality after-school programs to the greatest number of high-risk youth in the state; and

Whereas, On April 10, 2003, the Michigan House of Representatives, knowing the value of after-school programs, passed House Resolution No. 26, on the "Michigan After-School Initiative," to call for the creation of a task force to assess the status of after-school programming in Michigan and to develop a plan to ensure access to after-school programs for every school-age child in Michigan; and

Whereas, 21st Century Community Learning Centers promote an active level of community partnership and collaboration among providers to best serve children; and

Whereas, Polls show that 92% of Americans believe there should be organized activities for children and teens during after-school hours; now, therefore, be it

Resolved by the House of Representatives, That we memorialize the Congress of the United States to restore the proposed $400 million cut to the 21st Century Community Learning Centers program; and be it further

Resolved, That copies of this resolution be transmitted to the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.

A resolution offered as a memorial for Leonard F. Klida, Jr.

Whereas, The recent passing of Leonard F. Klida, Jr., the Bangor Township Fire Chief, has deeply saddened those whose lives he touched throughout his life. In remembrance of him and as an expression of our condolences to his, wife, Dawn, daughters, Marcie, Amanda, and Danielle, his entire family and his brothers-in-service at Bangor Township Fire Department, we join in offering this resolution as a symbol of our respect; and

Whereas, Leonard F. Klida, Jr. was born and lived his entire life in Bay City. He graduated from Bay City All Saints High School and received an Associates Degree in Fire Science from Delta College. Len began his career as a volunteer fire fighter for the Frankenlust Fire Department in 1978. He joined the Bangor Township Fire Department as a full-time firefighter in 1982, becoming Fire Chief in 2001. Len taught officer and firefighter training classes at Delta College and throughout the state and was a state licensed EMT. He was a member of numerous firefighter organizations and was the recipient of the Distinguished Public Service Award for heroism in l990; and

Whereas, Leonard F. Klida, Jr. was very active in community affairs, belonging to the Muscular Dystrophy Association, John Glenn Booster Club and the Snowmobilers Association. He was a member and lay minister of the Church of St. Boniface. Surely, we all have the desire to be remembered by those we encounter along life's journey, and for Leonard F. Klida, that is exactly the case; and

Whereas, Many considered Leonard F. Klida, Jr. a hero for his chosen profession as a firefighter. He was also a hero when not at work. Len was an example to anyone who strives to be a good family man. He had a deep concern for his community and all its people. His caring manner led to the positive growth of many organizations in Bay County; and

Whereas, Leonard F. Klida, Jr. had an unassuming leadership style and a tremendous positive impact on the lives of all he came in contact with. He was a rare person who you could truly count on. Many hold fond memories of him and admired him for his tireless efforts, his dependability, and commitment to addressing the needs of his community and state. We pay homage to his life and memory and honor those who were closest to him. We wish them comfort in their memories of a fine man, outstanding citizen and public servant; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body offer this memorial resolution to the family of Leonard F. Klida, Jr. May they know that the people of the State of Michigan have long held their public servants in the highest esteem. We wish to convey our respect, admiration, and gratitude; and be it

Resolved, That a copy of this resolution be transmitted to the family of Leonard F. Klida, Jr. as evidence of our sincerest condolences.
