A bill to amend 1984 PA 431, entitled
"The management and budget act,"
by amending section 213 (MCL 18.1213).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 213. (1) As used in this section:
2 (a) "Fund" means the motor transport revolving fund created
3 in subsection (4).
4 (B) "HYBRID VEHICLE" MEANS A MOTOR VEHICLE POWERED BY A CON-
5 VENTIONAL GASOLINE OR DIESEL ENGINE AND AN ALTERNATIVE POWER
6 SOURCE AS DETERMINED BY THE DIRECTOR.
7 (C) (b)
"Motor vehicle" means a passenger
vehicle, van,
8 minibus, bus, truck, tractor, or other motorized vehicle.
9 (2) The department may issue directives relative to all the
10 following for motor vehicles except for those motor vehicles
11 under the jurisdiction of the state transportation department:

1 (a) The purchasing, leasing, maintaining, operating,
2 replacing, and disposing of motor vehicles for all state
3 agencies.
4 (b) The using of state owned motor vehicles for official
5 business.
6 (c) The establishing of conditions for use of privately
7 owned motor vehicles on official business.
8 (d) The acquiring of vehicle registration plates.
9 (e) The maintaining of motor vehicle titles and insurance
10 inventories.
11 (f) The assigning of motor vehicles, permanently or tempo-
12 rarily, to state agencies and to institutions of higher
13 education.
14 (g) The establishing of rates to be charged for use of a
15 motor vehicle. The rates shall be reviewed periodically and
16 shall be sufficient to cover the costs of administration and of
17 the acquisition, operation, maintenance, repair, and replacement
18 of motor vehicles.
19 (h) The displaying of distinctive vehicle registration
20 plates and other external markings on the motor vehicles. The
21 plates and markings shall clearly identify state ownership unless
22 the motor vehicle is used by an elected official, or for an
23 investigative use, or anonymity is essential to properly perform
24 a necessary function of state government as determined by the
25 director.
26 (3) The department shall establish motor vehicle repair
27 centers and motor pools.

1 (4) The motor transport revolving fund is hereby created.
2 The revenue received from rates charged pursuant to
3 subsection (2)(g) and revenue which is received from any other
4 source and designated to be credited to the motor transport
5 revolving fund shall be credited to the motor transport revolving
6 fund. The amounts in the fund are continuously appropriated only
7 for administration and the acquisition, lease, operation, mainte-
8 nance, repair, and replacement of state owned motor vehicles and
9 related capital outlay and equipment.
10 (5) Assets and liabilities of the motor transport revolving
11 fund shall be considered assets and liabilities of the motor
12 transport revolving fund created by this section.
13 (6) BEGINNING OCTOBER 1, 2003, THE DIRECTOR SHALL DIRECT ALL
14 STATE AGENCIES TO PURCHASE OR LEASE ONLY HYBRID VEHICLES FOR USE
15 BY THAT STATE AGENCY.
