A bill to amend 1923 PA 150, entitled
"An act to authorize and empower counties, cities, villages and
townships or any combination of them, to singly or jointly
acquire by gift, devise or public condemnation a site or sites
and/or construct, erect, lease, sub-lease and maintain public
buildings for the purpose of housing within the same building or
buildings city, county, village or township offices, and/or for
any other public uses and purposes, which may include a memorial
hall for war veterans of the United States of America and for
public assemblage,"
by amending section 5 (MCL 123.925).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 5. (1) It shall be lawful for a A
county, city,
2 village, or township for itself and any other of said
THE units
3 of government to singly through its proper
representatives MAY
4 acquire, construct, lease, and OR
maintain a building or build-
5 ings for the purpose of housing TO
HOUSE any of their offices,
6 and/or OR facilities for any other
public use and purpose of
7 said THE units of government,
and which building may be or

1 include a memorial hall for war veterans of the United States of
2 America and for public assemblage ; and/or
AND to acquire a
3 site or sites therefor: Provided, however, No
FOR THOSE
4 PURPOSES. HOWEVER, NO county, city, village, or township shall
5 for such joint purposes and uses
acquire a site or sites
6 and/or OR erect any building or
buildings unless and until
7 such THE unit of government
shall have HAS entered into a con-
8 tract or contracts for the rental of a portion of such
THE site
9 or sites and/or AND quarters or space
with each of the other
10 participating units of government in such
THE amount or amounts
11 and for such THE period or periods of
time and in such THE
12 form as will provide revenues from payments to it of a reasonably
13 proportionate or equitable share of the total cost
thereof in
14 relation to the portion, space, use, and public benefits provided
15 in such THE contract or contracts for
the lessee or lessees.
16 Such THE contract or contracts shall
be executed following
17 approval and authority therefor by a
majority vote of the mem-
18 bers elect of ELECTED TO AND
SERVING IN the legislative body of
19 each unit of government participating in and a party
thereto TO
20 THE CONTRACT.
21 (2) The county, city, village, or township which
THAT
22 singly acquires a site or sites and/or
OR acquires, constructs,
23 and/or OR leases a building or
buildings for the purposes
24 authorized in this section may obtain funds for such
THOSE pur-
25 poses by gift and/or OR by means of
general obligation bonds
26 and/or OR by the issuance of
self-liquidating revenue bonds to
27 be paid from the revenues derived in pursuance of a contract or

1 contracts as above provided IN
SUBSECTION (1) and under the
2 provisions of Act No. 94 of the Public Acts of 1933,
as amended
3 THE REVENUE BOND ACT OF 1933, 1933 PA 94, MCL 141.101 TO
4 141.140. In the event that the revenues to be derived under
5 such THE contract or contracts shall
be only sufficient to
6 permit the issuance of revenue bonds for a portion of the cost of
7 the site or sites and/or OR building or
buildings, authority is
8 hereby granted to issue revenue bonds to the extent to which
9 such THE revenue shall permit.
: Provided, however, The
10 HOWEVER, THE entire improvement or improvements on
which such
11 revenue bonds are issued shall be subject to the provisions of
12 Act No. 94 of the Public Acts of 1933, as amended:
Provided
13 further, That THE REVENUE BOND
ACT OF 1933, 1933 PA 94,
14 MCL 141.101 TO 141.140. HOWEVER, as a prerequisite to the lease
15 or purchase of any property, the lease, purchase, or construction
16 of any building or buildings and/or OR
the issuance of any rev-
17 enue or general obligation bonds under the provision of this sec-
18 tion, the board of supervisors
COMMISSIONERS of such THE
19 county involved shall submit the question to the qualified elec-
20 tors of such THE county at the next
general election or at a
21 special election to be called by the board of
supervisors
22 COMMISSIONERS of such THE
county. : Provided further, That
23 HOWEVER, if the majority vote of the qualified electors in the
24 largest city of such THE county and a
majority vote of the
25 qualified electors in all the rest of such
THE county shall
26 vote in favor thereof OF THE
QUESTION, the provisions of this
27 section shall then become operative. : Provided
further, That

1 HOWEVER, no self-liquidating revenue bonds shall be sold unless
2 prior to the sale an advertisement shall be
IS made of the date
3 of the sale, the number and amount of bonds, and/or
AND other
4 matters covering such THE revenue
bonds. : Provided further,
5 That HOWEVER, sealed bids shall be
taken on the day of the sale
6 of such THE bonds from any and all
persons who may bid, and
7 that such THE bonds shall be sold to
the highest bidder at
8 such THE sale. : Provided
further, That the corporation and
9 securities commission of the state of Michigan shall
pass upon
10 and approve the form and general provisions of all
such bonds
11 before such bonds shall be sold: And provided
further, That the
12 THE proceeds derived from the sale of any and all
such THE
13 bonds shall be used only for the purpose of acquiring a site
14 and/or OR constructing building or
buildings, as authorized in
15 this act, and shall be used for no other purpose.
16 (3) The provisions of this section shall apply only to coun-
17 ties now having or which
may hereafter have a population of
18 300,000 or over according to the latest federal census.

19 Provided, That in any such county
HOWEVER, the provisions of
20 this section shall not apply IN A COUNTY unless and until the
21 board of supervisors of such THE
county shall adopt a resolu-
22 tion in favor thereof APPROVED by a
2/3 vote of the
23 members-elect of said board

25 (4) GENERAL OBLIGATION BONDS ISSUED UNDER THIS ACT ARE
26 SUBJECT TO THE REVISED MUNICIPAL FINANCE ACT, 2001 PA 34,
