A bill to amend 1917 PA 298, entitled
"An act to authorize cities and villages to levy a tax for the
purpose of collecting and disposing of garbage; and providing for
the issuance of bonds therefor,"
by amending section 1 (MCL 123.261).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1. (1) The city council of a city, whether organized
2 under the general law or special charter, or the president and
3 board of trustees of a village may establish and maintain garbage
4 systems or plants for the collection and disposal of garbage in
5 the city or village, and may levy a tax not to exceed 3 mills on
6 the dollar on
TAXABLE VALUE OF all taxable
property in the city
7 or village according to the valuation
of the same
PROPERTY, as
8 made for the purpose of state and county taxation by the last
9 assessment in the city or village for these purposes. The annual
10 garbage tax shall be in addition to the amount authorized to be

1 levied for general purposes by the general law or special charter
2 under which the city or village is incorporated. All cities or
3 villages may, for the construction of a garbage disposal plant or
4 system, issue bonds in a sum not to
exceed 3 mills
on the dollar
5 on
TAXABLE VALUE OF all taxable property in the
city or village
6 according to the valuation of the
same PROPERTY,
as made for
7 the purpose of state and county taxation by the last assessment
8 in the city or village. ,
and may make the bonds
run for a
9 period of not to exceed 5
years and to bear
interest at a rate
10 not to exceed the
maximum rate permitted by Act No.
202 of the
11 Public Acts of 1943, as
amended, being sections
131.1 to 138.2 of
12 the Michigan Compiled
Laws. BONDS ISSUED UNDER
THIS SECTION ARE
13 SUBJECT TO THE REVISED MUNICIPAL FINANCE ACT, 2001 PA 34,
14 MCL 141.2101 TO 141.2821.
15 (2) As used in this act, "garbage" means any putrescible and
16 nonputrescible solid wastes, except body wastes, and includes
17 ashes, incinerator ash, incinerator residue, street cleanings,
18 solid market wastes, solid industrial wastes, and also rubbish
19 including such items as paper, cardboard, tin cans, yard clip-
20 pings, wood, glass, bedding, crockery, and litter of any kind.
