A bill to amend 1978 PA 368, entitled

"Public health code,"

by amending sections 12521 and 12530 (MCL 333.12521 and

333.12530) and by adding section 12526a.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1 Sec. 12521. As used in sections 12521 to 12534:

2 (A) "DEPARTMENT", NOTWITHSTANDING THE DEFINITION IN ARTICLE

3 1, MEANS THE DEPARTMENT OF ENVIRONMENTAL QUALITY.

4 (B) (a) "Person" means a person as defined in section 1106

5 or a governmental entity.

6 (C) (b) "Public swimming pool" means an artificial body of

7 water used collectively by a number of individuals primarily for

8 the purpose of swimming, wading, recreation, or instruction and

9 includes related equipment, structures, areas, and enclosures

10 intended for the use of individuals using or operating the

1 swimming pool such as equipment, dressing, locker, shower, and

2 toilet rooms. Public swimming pools include those which POOLS

3 THAT are for parks, schools, motels, camps, resorts, apartments,

4 clubs, hotels, mobile home parks, subdivisions, and the like.

5 A PUBLIC SWIMMING POOL DOES NOT INCLUDE A pool or portable pool

6 located on the same premises with a 1-, 2-, 3-, or 4-family

7 dwelling and for the benefit of the occupants and their guests;

8 , a natural bathing area such as a stream, lake, river, or

9 man-made ARTIFICIAL lake; , an exhibitor's swimming pool

10 built as a model at the site of the seller and in which swimming

11 by the public is not permitted; , or a pool serving not more

12 than 4 motel units. is not a public swimming pool.

13 SEC. 12526A. THE DEPARTMENT SHALL SPECIFY THE MINIMUM

14 TRAINING REQUIRED FOR A PERSON AUTHORIZED BY THE OWNER OF A

15 PUBLIC SWIMMING POOL TO OPERATE THE POOL MECHANICAL EQUIPMENT,

16 CLOSE THE POOL WHEN NECESSARY, TEST THE POOL WATER, OR ADJUST THE

17 POOL WATER CHEMICAL PARAMETERS.

18 Sec. 12530. (1) The department shall provide for a system

19 of periodic reports covering the operation of the A public

20 swimming pool so that the department may readily determine com-

21 pliance with sections 12521 to 12534 and the rules PROMULGATED

22 UNDER SECTION 12522.

23 (2) THE DEPARTMENT OR A DESIGNATED LOCAL HEALTH DEPARTMENT

24 SHALL CREATE A WRITTEN RECORD OF EACH COMPLAINT IT RECEIVES CON-

25 CERNING A PUBLIC SWIMMING POOL AND OF STEPS TAKEN TO RESOLVE THE

26 COMPLAINT. THE DEPARTMENT OR A DESIGNATED LOCAL HEALTH

1 DEPARTMENT SHALL MAINTAIN A RECORD CREATED UNDER THIS SECTION FOR

2 NOT LESS THAN 3 YEARS.
