CHERRY, HAMMERSTROM and LELAND and referred to the Committee on Appropriations.

A bill to make, supplement, and adjust appropriations for the

department of state for the fiscal year ending September 30, 2001; to

provide for the expenditure of the appropriations; and to prescribe cer-

tain conditions for the appropriations.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

2 LINE-ITEM APPROPRIATIONS

3 Sec. 101. There is appropriated for the department of state for the

4 fiscal year ending September 30, 2001, from the following funds:

5 Grants to counties to upgrade voting equipment....... $ 15,000,000

6 GROSS APPROPRIATION.................................. $ 15,000,000

2 PROVISIONS CONCERNING APPROPRIATIONS

3 GENERAL SECTIONS

4 Sec. 201. Pursuant to section 30 of article IX of the state consti-

5 tution of 1963, total state spending under part 1 for fiscal year

6 2000-2001 is $15,000,000.00. State payments to local units of government

7 under this act are $15,000,000.00.

8 Sec. 202. The appropriations made and the expenditures authorized

9 under this act and the departments, agencies, commissions, boards,

10 offices, and programs for which an appropriation is made under this act

11 are subject to the management and budget act, 1984 PA 431, MCL 18.1101 to

12 18.1594.

13 DEPARTMENT OF STATE

14 Sec. 301. (1) From the funds appropriated in part 1, the department

15 of state shall develop a grant program and make grants to counties to

16 upgrade voting equipment and processes to have a single countywide voting

17 system.

18 (2) For a county to be eligible to receive a grant under this sec-

19 tion, the clerk of that county shall do all of the following:

20 (a) Convene the city and township clerks within their county to

21 determine the preferred voting system for that county. The selection

22 shall be made by majority vote of the county, city, and township clerks.

23 The clerks shall consult with the legislative body of the respective com-

24 munity before participating in the selection process.

1 (b) Select a single preferred voting system for each county under

2 subdivision (a).

3 (c) Report to the secretary of state the name and model of the pre-

4 ferred voting system for the county when submitting its grant

5 application.

6 (3) For a county to be eligible to receive a grant under this sec-

7 tion, the county shall pay not less than 50% of the costs to upgrade

8 voting equipment and processes to have a single countywide voting

9 system.

10 (4) As used in this section, "upgrade" means improving voting equip-

11 ment and processes to do 1 or more of the following:

12 (a) Eliminate overvoting.

13 (b) Provide notification of undervoting or other methods of spoiling

14 a ballot.

15 (c) Protect against tampering.

16 (d) Improve auditability.

17 (e) Expand voter access through the use of an on-line voting or

18 early voting pilot project.
