SENATE BILL No. 108

to the Committee on Natural Resources and Environmental Affairs.

A bill to amend 1994 PA 451, entitled

"Natural resources and environmental protection act,"

by amending section 8807 (MCL 324.8807), as added by 1998 PA 287,

and by adding section 3112d.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1 SEC. 3112D. (1) THE DEPARTMENT SHALL DEVELOP AND IMPLEMENT

2 A STATEWIDE MONITORING PROGRAM TO ASSESS THE EFFECTS ON WATER

3 QUALITY DUE TO BOTH OF THE FOLLOWING:

4 (A) DISCHARGES OF UNTREATED SEWAGE OR PARTIALLY TREATED

5 SEWAGE FROM SEWER SYSTEMS ONTO LAND OR INTO THE WATERS OF THE

6 STATE.

7 (B) DISCHARGES FROM ON-SITE DISPOSAL SYSTEMS.

8 (2) AS USED IN THIS SECTION, "PARTIALLY TREATED SEWAGE" AND

9 "SEWER SYSTEM" MEAN THOSE TERMS AS THEY ARE DEFINED IN

10 SECTION 3112A.

1 Sec. 8807. (1) The clean water fund is created within the

2 state treasury.

3 (2) The state treasurer may receive money or other assets

4 from any source for deposit into the fund. The state treasurer

5 shall direct the investment of the fund. The state treasurer

6 shall credit to the fund interest and earnings from fund

7 investments.

8 (3) Money in the fund at the close of the fiscal year shall

9 remain in the fund and shall not lapse to the general fund.

10 (4) Except as otherwise provided in this section, the

11 department shall expend money in the fund, upon appropriation,

12 for any of the following:

13 (A) FOR STATE FISCAL YEARS 2001, 2002, 2003, 2004, AND 2005,

14 $1,000,000.00 EACH STATE FISCAL YEAR FOR GRANTS TO LOCAL UNITS OF

15 GOVERNMENT FOR EITHER OR BOTH OF THE FOLLOWING:

16 (i) MONITORING WATER QUALITY FOR THE EFFECTS OF DISCHARGES

17 OF UNTREATED OR PARTIALLY TREATED SEWAGE FROM SEWER SYSTEMS AND

18 THE EFFECTS OF DISCHARGES FROM ON-SITE DISPOSAL SYSTEMS.

19 (ii) TRAINING INSPECTORS OF ON-SITE DISPOSAL SYSTEMS.

20 (B) (a) To implement the programs described in the

21 department's document entitled "A strategic environmental quality

22 monitoring program for Michigan's surface waters", dated January

23 1997. In implementing these programs, the department may con-

24 tract with any person.

25 (C) (b) Water pollution control activities.

26 (D) (c) Wellhead protection activities.

1 (E) (d) Storm water treatment projects and activities.

2 (5) Money in the fund shall not be expended for combined

3 sewer overflow corrections.

4 (6) The first priority for expenditure of money in the fund

5 shall be for the programs described in subsection (4)(a) AND

6 (B).

7 (7) Money in the fund shall not be expended until rules are

8 promulgated under section 8808.

9 (8) AS USED IN THIS SECTION, "PARTIALLY TREATED SEWAGE" AND

10 "SEWER SYSTEM" MEAN THOSE TERMS AS THEY ARE DEFINED IN

11 SECTION 3112A.
